      <title>Question regarding Time Warner Cable and CMI-- CA</title>

      <description>&lt;P&gt;Hi all,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My husband and I had Time Warner Cable and we had a zero balance when we cancelled our account in 2006. I returned all equipment in person to the local office and have the receipt showing our equipment was returned.&amp;nbsp; Several months later (midway into 2007) we receieved a letter from CMI stating that we owe Time Warner $334.97 due to non return of equipment.&amp;nbsp;&lt;/P&gt;&lt;P&gt;I refuse to pay this since we did return the equipment- all of it.&amp;nbsp; As I'm looking through some of our paperwork from all of this, I realize in October 2006 we had upgraded our receiver to a better one, returned the old one, got the new one- receipt shows serial#s for the old and new and is signed off from the gal who handled it at the local office.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;What I noticed on the 2nd receipt (the receipt for when I returned all equipment and cancelled account in Dec '06) is that the gal at the office wrote a couple of the letters/numbers in the serial# for the upgraded receiver we got back in October wrong.... so from Time Warners standpoint it looks like we still have a reciever out there due to the mistake of the gal at the local office.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have tried contacting one of the big whigs within CMI via an email I found on this site from someone who had good results but to no avail.&amp;nbsp; Does anyone have any idea what I should do??&amp;nbsp; I dont want to pay for something I returned yet this is holding us up from a mortgage loan.&amp;nbsp; If it came down to it, I would probably pay for half- for a PFD just so our mortgage hopes arent down the toliet... but, I'd prefer getting rid of THEIR error.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Any advice would greatly be appreciated.&amp;nbsp; Thank you!&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;Have you tried contacting Time Warner?&amp;nbsp; I would suggest going directly to a office so they can see the informtion that you have.&amp;nbsp; Sometimes talking on the phone does no good and being in person may shorten the time for the correction to be fixed.&amp;nbsp; Hopefully they will accept their error and pull the account back.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Good luck on this.&lt;/P&gt;</description>

      <description>My suggestion would be to contact a consumer attorney&amp;nbsp;to file suite against both&amp;nbsp;TimeWarner and the Collection Agency. With evidence, you should be able to find an attorney who will extract&amp;nbsp;your attorney's fees form the defendants. I don't know what your timeline is, but, armed with evidence, you can probably get this resolved out of court.</description>

      <description>&lt;P&gt;Another suggestion would be to contact the BBB and file a compliant.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Ask that BBB help you resolve the incorrect serial number that was written on the receipt.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;A friend of mine had a similar problem. &amp;nbsp;All equipment returned. &amp;nbsp;Cable company billed them for a box. &amp;nbsp;Refused to budge on the issue. &amp;nbsp;So they demanded back the box that they had returned -- the one listed on the receipt. &amp;nbsp;The cable company was unable to comply, but ironically, found a record/or found the box, that was "not returned". &amp;nbsp;The issue was resolved. &amp;nbsp;They had to go down in person to take care of the issue. &amp;nbsp; They were prepared to go to the BBB and file a compliant.&lt;/P&gt;</description>

      <description>&lt;P&gt;Thank you for the advise.&amp;nbsp; I actually have already contacted BBB but they were not much help. &lt;img id="smileysad" class="emoticon emoticon-smileysad" src="https://ficoforums.myfico.com/i/smilies/16x16_smiley-sad.gif" alt="Smiley Sad" title="Smiley Sad" /&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;After a fax, they finally responded to me via a letter mailed to us today.&amp;nbsp; It was pretty generic but stated that they had contacted Time Warner and Time Warner claims it is for a past due bill and not equipment-- yet the CMI collection notices we receive states specifically for equipment.&amp;nbsp; Now, I know there is NO WAY we had an outstanding bill for any amount of money from them.... let alone one for $334!&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;What should my next course of action be?&amp;nbsp; Should I contact CMI again or try Time Warner and demand a complete billing breakdown from the start of service to the end of service and see if things match up with my records?&amp;nbsp; Or should I send them copies of all my records (statements, payments/reciepts) ??&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;I agree with LilMirth.&amp;nbsp; You have evidence that they are not listening to.&amp;nbsp; That is why we have courts.&lt;/P&gt;&lt;P&gt;Dont pay it.&amp;nbsp; That wont help your credit score.&lt;/P&gt;&lt;P&gt;Either file action yourself in small claims court, or get an attorney who will recover fees from the defendant.&amp;nbsp; BBB may or may not write some letters, but they wont force anything immediate or legal.&lt;/P&gt;&lt;P&gt;Time for immediate legal action on your initiative.&lt;/P&gt;</description>
