The fastest way to Validate/Dispute with Pinnacle in my case?

Hi, i have Pinnacle collection on all 3 of my credit reports, for little over $8,000, this comes from my old Circuit City credit card, from what i am readying its not easy to validate with Pinnacle, i never got any letters from Pinnacle ever. So i am thinking not to mail any DV letters or BBB complains, just file a small claim in my local court. What is the down side in my case if i am filing small claim. I live in California. Thank you in advence.

Hi jjs8898! Welcome to the FICO Forums!

What, exactly, would you be suing Pinnacle for? What have they done that violates the FDCPA and is actionable as a civil matter?

The downside, if you owe the debt and it's withing the SOL, you could be counter-sued for the full amount of the debt, plus interest, and attorney's fees. You could end up with a judgment against you, and your wages could be garnished.

Given that you've not, according to your original post, requested debt validation & given them a reasonable amount of time to reply, I seriously doubt that your cause of action would be reasonable or sufficient. Has Pinnacle ever called you about this debt?

Is the debt yours? When was the date of first default? Has the statute of limitations expired for this debt? I'd recommend that you read: What Steps Do I Take? Do I DV? PFD?

Thank you for all your feedback, i was looking at my Credit, and it says that last time it was use Mar, 2006, the debt is my, i have also read the link you gave me, thank you. I not going to push it now, i will just send a reguler DV to CA and see where it takes me.

Hold on there. First, can you afford to pay the balance in full? And, what's the SOL for the debt (it may be the state that you lived in when the debt was incurred, or the state that you currently live, if you've moved-- assume the longest SOL)?
