Hello...alright, I received a collection letter in the mail today (2/10/10). It was from Washoe County stating I owe a past due amount of $190 and they have alerted all Law Enforcement agencies of my non payment and an arrest warrant has been issued? I looked at my CR and it does list the account on TransUnion. It's an account listed under my bankruptcy in 2005, so I did not "tend" to it as I am doing the others not listed under my BK.

Here is how it is listed:

Account Name: Washoe County

Account # : XXX (it is only showing first number)

Account Type : Open Account

Status : Closed

Monthly Pay :

Date Open : 7/2/2004

Balance :

Terms :

High Balance : $190

Limit :

Past Due :

Pay Status : Unrated or Bankruptcy

Comments : Chapter 7 Bankruptcy

I thought that any account that was included in my bankruptcy was non-collectable after my discharge (2/2005)

I have not DV, PFD, or have any communication with Washoe County. What made them decide to send a letter and put out a nationwide arrest warrant?

This is one that you DO NOT want to ignore. Call the County & speak with someone about this. It's very possible that Govt payments (whether County, State or Fed) cannot be included in BK, just as Fed student loans cannot. I don't know this as a fact about these govt bills, but for $190.00, do you really want to take a chance? If you have the cash, it's best to go in person, pay the bill and keep that recpt with your birth certificate!!! (as in...keep it safe & never throw it away!)

There is no debtors jail, so this has to be an issue of some govt issue where the money is just somehow involved. I agree that you should not ignore it, but try to deal with the county and not with any sort of CA. If a CA comes at you threatening jail time, I would be cautious of thinking that it is not legit.

What chapter bankruptcy did you file? What is this debt for?

Some debts can't be discharged in bankruptcy. Governmental fines & penalties are one example. Another is child support, alimony, and that type of domestic support obligation. I agree witht he others, definitely don't ignore this!

Any debt related to the criminal code (this includes parking & speeding tickets) cannot be discharged in BK. BK only discharges "civil" debts, meaning debts of contract or commerce. Those imposed by a judge or government for violations of criminal code stay with you forever, and a bench warrant can be issued for a variety of reasons ranging from failure to pay, failure to appear, etc.

Therefore, you have the worst of both worlds....a debt, which becomes a collection, that has the protection against BK and will be enforced both civilly and criminally (fines/garnishments/penalties plus jail).

IME not something to ignore. Good luck.

Okay, I called and was given about 5 different numbers to call. Finally, someone said they are going to investigate to see the accuracy of this "arrest warrant" and debt owed. If I dont hear back by 1 today, I am to call him.

One more thing...if you end up going to them to pay, also bring a copy (or copies if on all 3 reports) of where this is on your reports. Make sure you talk to them about the steps necessary to get this removed from your files.

An arrest warrant CAN be issued if it was a returned check they're trying to collect.

It wasnt a returned check.. Someone was doing a little pre-spring cleaning and came across the account 6 years later. Noticed it was unpaid and re-issued an arrest warrant. I did pay in full and I was given a confirmation number. But I did ask for it to be deleted....drum rolls...........he agreed. I also asked for it to be in writing and sent to me with a letterhead of Washoe County, ASAP. He agreed.
