Can anyone tell me the process after I make the last payment? Does the Trustee and my Attorney get notified? Does the Trustee automatically start the DC without intervention with me? Do I have more paperwork to do or another POST hearing?
You sit back and wait. Trustee will audit the account and then the discharge process will start... which could take days... or it could take weeks depending on the court.
As TRC said you mostly wait but there's a form you need to sign affirming you're not behind on child support (doesn't matter if you're married or if you have kids, everyone has to sign that form) ... your attorney will reach out shortly or you can be proactive and just let them know you made the last payment to they send you the form to sign
In my case - I reached out to the auditor handling my case at the trustee's office a few months before final payment just to be sure we agreed on remaining $$ to pay (my attorney was off $100 which would have delayed things so glad i reached out, years ago at the start of the case we ended up having a hearing in front of the judge and my payment was increased $100, my attorney miscalculated the month this was supposed to start)
In my case - I made my past payment 10/31- discharged was issued 12/27 (just to give you one person's experience, but I know others that have been longer or shorter)
But here's the most important thing....YOU MADE IT ACROSS THE FINISH LINE!!! CONGRATULATIONS!!!!
I am not sure how it works in your jurisdiction. In Southern Dist. of Texas, my last payment was July 23. My attorney filed a motion for discharge 07/24/23. I had my discharge issued on August 18th. Trustee also sent a notice to employer to stop payroll deductions and sent us a refund. I had a great attorney. She helped me obtain mortgage with 10 months left.
