CHAPTER 7

Does the trustee decide that you can do a chapter 13 instead of a chapter 7? For example you fill out all of your paper work for a chapter 7 and pay the chapter 7 fee. When you have your 341 meeting of creditors and after that can the trustee contact your lawyer and tell them you can do a chapter 13 instead of a 7 or would they let your attorney know this before the 341 meeting of creditors?

That would be determined before you even file with your attorney. You will take the "means test" to determine which one you would qualify under, and that would be what you file.

A trustee can overturn a 7, and force a 13 if needed, but those are rare circumstances. Your attorney will guide you best after you take the means test.
