Chapter 13 Discharge Process

Trying to figure out where we are in the final process of ch 13 discharge.  We have been reading many different posts and it seems every situation is a little different due to local forms etc.   Last payment was 3/3/17. On NDC our case says Completed-Pending  (does this mean pending discharge?). 0 balance on hand &  final disbursements made 5/2/17.  Also, NDC says case closed 5/2/17 same day as final disbursements. On Pacer  - Completion of payments filed 5/4/17, Certificate of Compliance filed (financial course completed), and Notice to Debtors/Creditors Concerning Issuance of Discharge filed 5/5/17.. What exactly is this form?  It says that a discharge will be granted without further notice unless within 21 days creditor files /disagrees to Homestead/ Equity.  Just trying to figure out where we are and if there is another audit after the 21days or not.. How long do courts wait for checks to clear?

We're thinking we are in the final 2-3 weeks provided there is no objection to the "equity homestead"  issue.  Anyone else have to wait for this 21day period or is it standard?

Also, in general anyone know how long after the 21days does it take for ch 13 discharge to be received?  Thanks

You can PAY - OFF everything, and that does not mean that you are done.

 

The Trustee has to review all of the paperwork, and then "request" that the Bankruptcy Judge declare a Discharge.  At that time the Court will then report the Discharge.

 

* I had a very good phone relationship with the administrative assistant who worked for the Trustee.

 

That person was able to kindly keep me informed of where in the process I was, and what actions still remained, and how long that would take.

 

If you are willing to call the Trustee's Office, you should be able to get answers to your questions.
