Chapter 13 length of reporting?????

How long can a CRA like Teletrack report a Chapter 13 BK that was discharged on 4/2008?

I filed back on 4/2003 and they say that they can report the Bk for 10 years and not 7 years as I thought.

Is this correct?

Any comments would be appreciated.

A discharged Chapter 13 are typically removed 7 years from date of filing.  But that is from the CRAs, not Teletrack.

Chapter 7 remains for 10 years from the filing date. Chapter 13 remains for 7 years from the filing date.

 

They are blowing smoke when they say 13 years. Even the 10 years is incorrect.

 

I am not familiar with Teletrack but I assume (could be wrong) that they are governed by the same FCRA regulations as all CRA's.

 

Tell them to read FCRA 605(a)(1):

 

(a) Information excluded from consumer reports. Except as authorized under subsection (b) of this section, no consumer reporting agency may make any consumer report containing any of the following items of information:
(1) Cases under title 11 [United States Code] or under the Bankruptcy Act that, from the date of entry of the order for relief or the date of adjudication, as the case may be, antedate the report by more than 10 years.

 

ETA: I found this from the Teletrack website: As an FCRA-compliant consumer reporting agency, Teletrack gathers records from businesses across the country who cater to non-traditional credit consumers.

EQ - 7/06-663, 3/10-800
TU - 8/10-772

I noticed you edited your post.

 

I'm just thinking out loud here but Teletrack's out might be that FCRA 605(a)(1) doesn't differentiate between Chapter 7 and 13. It just says a BK can't be reported longer than 10 years.

 

I don't know. I'll let smarter people than I comment on this.

Both can report for 10 years.  The Chap 13 is typically removed early.
