My spouse and I are currently about 8 months into CH 13. We filed a CH7 late in 2002. I know we cannot covert it into a CH7 because it hasn't been 8 years (it will be in November). We have decided to divorce and will start proceeding in a few weeks. What will happen with the CH13? There's no way we can maintain separate households with the income we have left over after making our BK payments. Also, could we both convert into CH7 (separately, our divorce should be final by this time)in Nov since it will be 8 years? I know I need to consult my attorney and do have an appointment later in the week to do so. I was just wanting some input in the mean time. Thanks for any info!
