Has anyone fired their attorney?

My situation would be too long review here, however, my attorney is awful and I am wondering if anyone has fired their attorney?

My petition has been filed and my hearing is in a few weeks, however, the US Trustee is involved for some reason.  My attorney was supposed to provide docs to the US Trustee two weeks ago, however, I just found out he has not provided the docs.  This truly is the last straw with this attorney.  I could go on and on with the screw ups, and I've had it.  

Does anyone know what would be involved in switching attorneys at this point?

I know your experience with hating your attorney. Might I suggest this is coming from a place of stress, as Bankruptcy is not a relaxing time until it is complete. During my Chapter 7 my attorney dropped the ball and was almost impossible to get in touch with just their paralegal assigned to me, having weeks, or even a month between my question and their answer. I would suggest you to just stay the course, especially if your in a chapter 7. 

If you are in a chapter 13, you may want to call around and see if another attorney will replace yours, but you probably will be stuck with the bill by both attorneys.

Yes, this situation is very stressful indeed.  However, my attorney has made this process 1000% more stressful.  Yes, it's clear I do not like him at all and for me, that's highly unusual. The day I was to sign the petition, he literally yelled at me for 20 minutes...no joke!  Then left the room to decide what he was going to do next.  When he returned, he made me sign a statement that I was happy with his service and I would not post anything negative against him or else he would not continue with my case.  I'm sure I sound crazy or unreasonable, but I promise I am not and I only respond to his negligence.  I feel like I am in the twilight zone when dealing with this attorney.

Hope things works out for you. As others suggesting if you are CH7 then just move foward and get it over with it and move on with life. Good Luck.

I changed attorneys during CH7 but it had to do with a number of errors the attorney made that cost me a number of assets. I shopped for my new attorney extensively and he was very clear from the start that because of the mistakes we were fighting an uphill battle but he would do what he could. The move definitely helped.

 

As far as the process, once I hired him I sent an email letting my attorney know I was going to different counsel and that they would be in touch. My new attorney emailed my old one a Substitution form and requested all of their files. Old attorney signed the sub form but refused to turn over files. That made it more difficult moving forward but I made the move none the less. I had a very complicated case and for me it was worth spending the money.

 

If I were in your shoes I would definitely meet with a few attorneys to explain the situation and then make your decision. 

 

ETA: Changing attorneys and dealing with all the BS cost me a lot of money in attorney fees. Most attorneys taking a case over won't do a set fee, they will bill by the hour.
