Help!! Collection Acc initiated AFTER BK-7 filing

I filed for BK-7 and included a medical bill for $107. Creditor was notified in August 2012. BK discharged in November 2012 and some month, creditor sends $107 to collection agency, causing FICO drop of 30 !!!!

I disputed the account on my CR since BK-filing STAYS all collection activity but to no avail. Collection Agency refuses to delete it and still reports it as negative account with balance of $107.

What should I do??? FTC? Please help with suggestion!! It has to be unlawful

Send them an intent to sue ltter, or have your attorney do it.

Absolutely send them an intention to sue for violating the automatic stay. Also, actually go through with it.

Thanks guys!!! I took care of it this morning, sent the letter via USPS priority mail with tracking. The CA got my score (after BK) to drop from 542 to 515. Big deal & I was so discouraged. I sent a letter to the original creditor too since they BLATANTLY ignored the federal stay. I will you you posted :-)

Is there a copy of that letter somewhere on here? I am having the same problem! Bill was given to a different collection agency AFTER bankruptcy but the original bill was included in my bankruptcy. The CRA's won't delete it because it is showing a date after my filing date. They don't have all the info and it is very frustrating for me!!!

I sent a letter with notice of willful violation of FCRA and federal laws, and included conformed copy of BK-filing's page with the creditor AND copy of court's certification of service on the creditor. I wrote to original creditor, CA and all 3 agencies and included the whole enchilada. If you send PM I can give you the text

Hi Guys,

 

I am new to the forum, but very excited about it.  I, too have the same problem, contacted my attorney, he confirmed that the Original Creditor was list in the BK (13), and advised me to send them ALL a letter, stating this account was included in BK.  He also advised me to instruct the CA to DELETE the item and send me notification that they have complied, or further actions would be taken.  Received notification from TU and Equifax that the item had been deleted, and my score went up tremendously.  I, like many is very excited about scores in which i am achieving now.  I know what got me into this mess, and I keep that in front of my mine, so that it won't happen again.  I did receive a secured credit card from my Credit Union, as well as a secured loan, which also boost my score.  I am also waiting for that 700 plus score on all three.  Thanks for all your help, I really appreciate it and it has helped me a lot. Smiley Happy
