Preferential Payment

I plan on keeping my debts current before filing, this will mean I could be affected by "Preferential Payment" even though it's normal payments.  My question is will this hurt me in anyway, will the creditor change my payment received to a late payment?  I am trying to keep my payments without any lates and filing BK chap 7.

Well, without commenting on the wisdom of continuing making payments once you have decided to file BK, to be safe and avoid possiblity of "Preferential Treatment" of one creditor over another just make the minimum payment due for any account. If you just make the minimum payment due for any/all accounts it would be pretty hard for the Trustee to claim preferential treatment/payment.

 

Preferential Treatment comes into play most commonly when you repay your debt in full to a friend/family or even favorite lender before filing.
