chapter 7 and new cards

just found this forum. i am filing chapter 7 in the next few weeks, i have i guess prematurely started to rebuild withh comenity cards (6) chase and boa. all have zero balances. will the lenders cancel these once i file or will freezing my reports save the new cards?

The lenders will most likely cancel them. You could call and close them so they reflect that.

You can't "prematurely" rebuild. Know why? Because when you file a BK, ALL acts and assets are listed on your filing, and the BK itself is immediately reported to the PR which the CRA pick up.

All new your acts you got "knowing you were going to file", will go away as soon as the lenders get notice of your filing. Your Attorney, may also suggest now that you should wait 6 months before filing, because you went out and got all that new credit regardless if they are zero balances. Bad move getting cc's before filing a BK. The judge and your court appointed Trustee will see all new new credit, because they pull their own credit reports on you for that reason, and go dismiss the case.

Id close the cards now, but if you leave them open, they will be included in your schedule on BK, and now you've got Chase IIB, which it'll now take years to get back in with them.

We were waiting to see if any of the old accounts would fall off the reports before deciding to file since most are not mine ex spouse is liable. Now i just got served papers on an account stated suit which there is no defense in florida so we have to speed up the filing. 

 

The new cards are a couple months old and there was no ill will in getting them we were not even sure if we were filing or not until this suit happened. 

 

Would that still be an issue?

I really, really hope for your sake you are NOT filing in the middle district of Florida.  They are some of the toughest trustees in the country.

 

I would speak with a bankruptcy attorney for a consultation and see what they advise.  Ill will or not, a trustee is not going to be looking at your "intent" they are going to be looking for a reason to discharge your case - you've given them one. I'm not a lawyer, that's why I'm suggesting you find one.

thank you for replies, my husband does not pay attention when he writes things due to be older and just not understading much. and now his account is locked out.

 

allow me to clarify what he attempted to say maybe it will make more sense.

 

we had no intention to file chapter 7 until this week when we were served papers, before that, reports were not showing any negative items and he acquired several cards. would that still be an issue for this matter? i assume when he say rebuilding he meant since the reports were not reflecting negative items trying to increase his score.
