I am considering filing bankruptcy. Possibly a ch 13. I  have been researchin a lot but still would like opinions. 

I am filing primarily to have one lump sum payment. I also want to cram down my car interest. i didnt realize the pain that would come from buying a car before having a car payment. Essentially I have paid the beginning msrp of the car off. the final few years will be interest.

 


I have about 8500 left on the car, 2 collections around 1,000, credit card debt at around 10,000

I am current on each card and also current on auto payments. 

 

I could pay the car and everyhing as I am now but I got a 30 day late about 2 months ago. I got about 5 (30-60) and (60-8)9 about 2 years ago. 

 

 I figure for all it is worth I may as well just go for the ch 13 while I am young and start over and do things right.

Please list your current debt
Age of accounts and balances with late history

Please also list if you have a car or a mortgage or if you rent. How much is the car worth vs what you owe how long have you had it


What is your income?

Ch7 is always better than 13 most times
The both hit you just as bad on Credit and one gives you a clean slate.

kbb 2500-3000
had since 2014

C.f. debt
7000

taxes around 2,000

late payments on accounts about 3 years old

2 collections
Around 1,000 total one loan and one medical about 160.00

no mortgage rent through family

income around 45,000

Current on stuff just want to get done with the car it's dragging and the overwhelming stress from multiple small payments each month..

What state do you reside?

You could be under the income for your state and qualify for ch7
Get rid of the car and get a new one

If you are over the income you may still qualify by the means test

You said you live with family. Do you pay rent? File tax return as single or are you a dependent of theirs? Depends if you have to include their income or not

How much rent? And how do you pay check or cash? You’ll have to be able to prove it


If you are over the income you can still qualify for ch7 via the means test although easier if your income is under really quick

Are you expecting to get taxes back this year?

Ch13 is good if you have high income and a home you are trying to save. You don’t have either. I wouldn’t say your a good candidate for it

They total all you unsecured debt and divide by 36/ or 60 months

They also take your disposable income from the means test and multiply by 60.
And that’s your payment what ever is less

Doesn’t leave you with much money. And ch13 Costs much more in the long run.

I live in va

I pay cash for rent I have paid with a check a couple of times.

My thing is my car is my only way to go and come
that's why I was thinking 13

But I file single and and have no dependents my mom live with me but I can't file her because she works pastime time and I saw somewhere that she had to file herself..even tho I'm the higher earner

So what's the difference in filing and not just staying where you are if you still have the same bills..just wondering ??
