Anyway, even if it was a mistake it doesnt give you recourse to spend the money... Also he'd have to pay taxes on the interest...
I'd turn the check into a bank check and keep it somewhere safe for a year.. Then deposit it >_<

Another option for the money if it does get sent to your account is to donate it to a charity even when vs takes back the money they would have leave some of it with the charity or take a huge PR hit.

I remember when I quit Walmart in High School and they sent me a  401k check for 2 cents I still have it 16 years later. Thats looks like everyones 401k today.

i would definitely do this. put it in a savings account and or/cd money market with the highest apy offer and wait until they admit their glitch. do this indefinely (never cash it ever until you have confirmation with a lawyer) as you will always be able to make money off of interest.
