Cap One question

I have an account with cap one that is 6 months from SOL expiry and they have initiated suit through a CA. i have been served and have an Aug 08 court date. balance is $1,000. Should I deal with CA or attempt to get in touch with cap one collections and see if they will take payment and change status from chargeoff to paid as agreed/closed. Will the OC deal with you after the CA has filed suit or will they just leave it to them? What should I do? Thanks......

I would mail a PFD in full to CapOne. I would also call them to negotiate a PFD of sorts via the phone; give you the chance to figure if CapOne will work with you or not. I would also DV the CA, if you haven't done so. CapOne isn't likely to accept a PFD, but I would send multiple letters monthly to several addresses. I'd even send to the higher-ups at CapOne. If they don't accept by mid-June, then I would mail payment in full based on the amount on the summons, if available.
