How Do I Deal With A Default Judgement By The Devil aka Midland Credit Management?

Hope everyone had a safe and a Happy New Year...

 

Anyway, when I pulled out my Experian CR this morning, this came up in my detailed account section…

Unfortunately, I didn't take care of this matter and Midland got a default judgement on me last year.  Though I don't have Midland on my Collections or Public Records section on my CR, it bothers me that they report virtually every month for being 90+ days late.  What would be the best way to deal with these devils?

 

Also, is the SOL for this debt reaged since Date of last payment (from a levy) is Feb. 2007?  Thanks for all your help…

Yes the CRTP and SOL resets with a judgement.
 
What state was this in?  If the judgement was 2/07 you still have a small bit of time to try and have it vacated due to improper service, past collecting SOL etc but if you don't try now you are stuck with it.
 
I would begin by sending a DV to Midland regarding the debt.   Midland is nasty and hard to deal with... you might want to check into speaking with a lawyer at www.naca.net to assist you

First of all get that DV out tomorrow.
 
Cali's collecting SOL is 4 years for open accounts.  What was the original debt and can you locate the DOFD or DOLA on it on any of your CBRs?  I would not go by the Midland's reporting of May 2002 on its own.  If this is not a complex issue and the debt occured in CA and you reside there (no other states involved at all during the timeframe), it looks like they won the judgement because you were not there to tell the judge that this is not collectable due to the SOL limitations.
 
So, get the DV out and get all the info together that you can on the debt and dates.  As well, did you ever receive a summons? 
 
Call the court that issued the judgement and speak with the court clerk.  They will tell you what you need to do to file regarding the motion to vacate.  This needs to be done ASAP due to time contstraints... seriously. 
 
I do suggest speaking with an attorney with anything like this.  Not only might they be able to speed things along, they can make sure there are no errors in how you are handling it and also assist you if you wanted to sue Midland for court costs etc.
 
If Midland did sue past SOL, you will do all of us good folk like yourself a service by filing complaints on them with your AG, BBB, and the FTC.

If when this is all over you find that the OC still owns the debt (doubt it) and you wish to pay it, just make sure you ask here how to do so and clear yourself without it backfiring.
 
Keep the DV simple, do not mention the judgement as it is inapposite on Midland's legal obligation to validate... send CMRRR. 
 
Be nice to the court clerk even if they are grumpy.  They can help you out a lot.  Smiley Happy

Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested. This is NOT a request for �verification� or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you . OC definitely doesn't own the debt. OC is Providian and they sold it, I believe to Midland...

Pay particular attention to the "Plaintiffs and Defendants...The Judgement" section, particularly the 'Correcting an Error' sub-link.
 
Also see "After the Judgement... Collecting or Satisfying the Judgement" section, paying particular attention to the 'Prohibited Debt Collection Practices' sub-link.
 
In Cali, if you were not properly served, you have up to 180 days after learning that the judgement was entered to file a Notice of Motion to Vacate Judgement. 
 
Back to the DV, a time bomb will not go off if you do not send it tomorrow.  It's more important that it's a good DV... but aim for Thurs or Friday at the latest to send it.  If you need help with it or want someone to check it, post it on a new thread and XXXX out any personal info.
 
Again, I'm not a lawyer and any lawyers on these boards are not YOUR lawyer... which is why I always recommend consulting one in a situation like this.
