Question about original creditor and CA. . .

the orignial creditor which is Capital One has my account listed as open, but upon further review it says closed by credit grantor.  Well I have drafted and am sending them a PFD letter.  I also noticed that a CA is also listing this account.  If I am successful in the PFD letter with Capital One does the CA have to remove theres also or do I have to send them a PFD letter and pay them to?

Just make sure the PFD stipulates that both TLs be deleted.

I have already sent the PFD letter to Capital One, before I noticed the CA.  If they respond to the letter, can I add the CA then?  Before I send the money?

It also depends on whether the CA owns the debt or is assigned to the debt.   If they own it outright, bought it from Cap 1, then you will have to deal with them separtly.

No need to write a new PFD, just make sure you have everything they agree to on signed company letterhead before sending a dime.

If they did purchase it from Capital One, and I settle and pay Capital One does that mean that I have to pay this account twice?  Once to Capital one and once to the CA?  Capital One is listing on my report as an open account but past due, but also says charged off closed.  The CA is also listing on my credit report but only as a CA.  What do I do?  I do not want to have to pay this twice.

No, but you will need to keep the documentation that you paid the debt with the OC... You may need to dispute after you have received the receipt and letter agreeing to delete the TL. AND REMEMBER don't send original documents when disputing with CA.

Re: Question about original creditor and CA. . .

More than likely the OC will just tell you that they aren't dealing with it anymore and you have to talk to CA.    So don't send any payment to the OC until you have to confirme whether they still own the debt and just assigned to a CA or they sold it.    And if they still own the debt you stil have to get them to agree to accept your payment and if they do you should take it upon yourself to follow up with the CA and notify them that the debt has been sastified with the OC.   don't rely on the OC to do this and save all your paperwork for proof.

But you can't just willy nilly send in any money to the OC until they have agreed to accept your payment.  So find out who actually OWNS the debt.

Re: Question about original creditor and CA. . .

I just sent out the PFD letter this week.  If I find out that the CA owns the account i will just send them a PFD letter.  If I do indeed end up having to PFD to the CA once everything is finished with them would I send copies of everything to Capital One so that they can delete everything?  It is hurting my report because they are showing as open with past balance and overlimit.  Will the OC have to delete once everything is is settled with the CA?
