Should I request a DV?

I have a charge off account with Devry that according to Experian is scheduled to come off 11/2010 and is unpaid.  The account was successfully removed from my Equifax report, but remains on my Experian.  Should I attempt to request a DV and re-dispute this item?  If so, what's the correct way to do this?  The account was charge off'd in 4/2005.

No.  I went to devry one semester and decided I did not like the school.  They say I was scheduled to take a class the following semester that I never attended.  And because I don't have proof of withdrawing from a class I never attended the Atlanta branch I attended won't give me any assistance.  However, the main office is listed on my credit report.

Have you already disputed this Devry account with EX as not mine?

Yes I have and they said it was verified.  But I'm sure the main branch is just looking in a system or something.  Because they can't have anything written.

Yes, Devry is reporting this as a charge off.  I just want to get this removed and would hate PFD when i knw it should not be listed in the first place.  So, I thought the DV may be an option.  But I don't know anything about it really.

Your situation is a bit tricky. You already disputed with EX and it came back verified. For one, your asking if you can DV the OC (original creditor), Devry School, on a debt that is not yours. As far as I know, any TL (tradeline) that is not yours can be DVed. Question is, can you DV OCs or does it have to be a CA! Let me get back to you on this.

Found something for you. You can DV an OC, but it carries no weight under the FDCPA (Fair Debt Collection Practices Act) .
Applicability of the FDCPA - It matters if the listing is from the original creditor or collection agency

The FDCA does not cover collection tactics employed by original creditors (like credit card companies who issue credit cards). It only governs the actions of a debt collector (collection agency). Let's look at the definition of these two groups as defined by the FDCPA.

TITLE VIII - DEBT COLLECTION PRACTICES [Fair Debt Collection Practices Act]
§ 803. Definitions [15 USC 1692a]
As used in this title --
(4) The term "creditor" means any person who offers or extends credit creating a debt or to whom a debt is owed, but such term does not include any person to the extent that he receives an assignment or transfer of a debt in default solely for the purpose of facilitating collection of such debt for another.

What does that mean? It means that, as far as the FDCPA is concerned, a creditor is the original entity which loaned money to a consumer. It is not a collection agency. The definition of a debt collector is as follows:

TITLE VIII - DEBT COLLECTION PRACTICES [Fair Debt Collection Practices Act]
§ 803. Definitions [15 USC 1692a]
As used in this title --
(6) The term "debt collector" means any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another.

The threat of a DV might scare them away if they know they have no standing to collect a debt that isn't yours. No guarantee though.

 Just FYI.....just because they say it was verified does not mean it was done so properly, or done at all. I disputed a balance that was paid in full, and the Credit Bureau was still posting it as having a balance, so I disputed.  They came back and said the balance was verified. The only thing that changed on my report was the date of last payment. I made the payment in full on 05/14/2007, yet they posted date of last payment as 06/2007, and STILL had a balance.  I called them (the CB) and asked how this was so, as I paid it in full. She stuttered for a moment and then started another investigation. Still waiting for the results of that one......
