TU won't take off dispute line

I've waited 30 days for Transunion to take off the line that reads "Account disputed by consumer" because these disputes have been resolved. They send me a letter back stating the investigation is over, however, the dispute line is still on my report. I called this morning and they told me that they couldn't take it off and that the creditor had to take it off and apparently they creditors didn't want it taken off.

 

Of course, I asked to speak with a supervisor and he told me the same thing. Why would the creditor have to take off my dispute remarks? Is this correct? I had no other issues with EXP & EQ. What happens if the creditor won't take it off? I thought the Credit Bureaus are supposed to take it off. Now I have to wait another 30 days.

 

Any advice is appreciated.

If you dispute an account to the creditor, they are obligated to report the account is in dispute.  If you dispute to the CRA, they will indicate the account was in dispute.  If verified, usually it will be updated to say "Consumer disputes......meets FCRA"

 

Similar to inquiries, CRA's and creditors are required to disclose or report certain things. 

 

However, it is more likely that the OC doesn't want to take the time to deal with the request moreso than their dedication to a potential requirement of reporting.  If you send a letter stating that the account is not in dispute or no longer in dispute and would like the remark removed because it no longer or does not accurately reflect your position, they should be able to remove it, "if they want to take the time and effort to help you out."

If the remark is reported by the creditor, then the creditor must remove it as this is not an insert by the CRA.

I spoke with the creditor and they said they couldn't do it. That some law back in the 90's was changed. If they are the ones to do it, why wouldn't they take it off?

It is the creditor who placed that on. In my early and uninformed days, I disputed all the time. One was a car note with several lates. I initiated the dispute on 8/07 and to this very day it is still listed as being disputed. I did talk to the OC only one time and they admitted that they placed the comment but added there's nothing I could say to them to get it removed. It has to say, "account was disputed" or something like that. But it says "account in dispute". Now the good thing is that FICO reads that comment as an active dispute. My lates aren't factored into scoring. I have 14 lates and my payment history is listed as "Great". If they remove the comment, my score will drop. This is my only baddie.

Keep hammering the OC if you want it changed.

Thanks guys!!  It's just frustrating because I'm trying to buy a house and this is the only thing keeping me from it and I have been waiting for these bureaus to get it off and both the TUand the creditors are telling me they cannot take it off.

 

I contacted the correspondence department at TU and they said it should have been taken off  so she is going to contact the creditors and if they give her a verbal statement that it is resolved then she will have it taken off right away. If not, I will be on the creditors like crazy. Smiley Happy

Did your lender tell you this would cause problems in your loan?  I don't see how/why.  If the account accurately reports and reflects the proper payment history and balances, then it shouldn't really be an issue.

 

If the lender asks what the dispute is/was, just tell them there was a small error that they corrected, but the comments continued to reflect the dispute.  Usually a reasonable explanation would suffice.

I've mentioned the reasons to him and also asked if I can write a letter of explanation or something. He just told me to contact the creditors to which I told him that I have and they stated they couldn't do it. So, I'm waiting to hear back from him as well.

 

He is the one who stressed that these need to be taken off to go thru automatic underwriting.
