collection calls help

I have hit some hard times, and am unable to make payments on a couple of my cards. They are with Cap 1.

Well, I moved back in February, and was able to make my payments that were due in the end of march, so they have my new address/phone number.

Cap 1 is still calling my old phone number (which is not on my account info pages, I deleted it) which belongs to my MIL. She says that they are calling for me several times a day, and every time she tells them that I do not live there anymore.

This is getting really embarassing for me. They DO have my telephone number, the only time they call me, it's an automated message telling me to call them back. It's apparently a real person that is talking to MIL.

Can someone please tell me how to get them to stop calling my old telephone number? I can't afford to pay them regardless, but am getting sick of the embarassment.

Re: collection calls help

If they can't get in touch with you then they are allowed to contact friends, family, neighbors etc.  They shouldn't contact her again once she tells them that she doesn't know how to reach you.  If they think that she is not telling the truth then I do believe that they are allowed to call again.  They aren't allowed to call multiple times a day though.  I would research FDCPA and tell her to advise them not to call again per FDCPA.  My sister just recently had a creditor (from 20 years ago!) call MY ex-husband!  I think the only way you will get it to stop is to contact Cap 1 and advise them of your situation and see if you can work something out...even if it is only a very small monthly payment.  Cap 1 is notorious for suing so I really wouldn't let this one sit out there too long
