"Frivolous Request" - CA won't validate medical debt

Preface: In Texas and this is a medical account. RS Clark and Associates is CA

 

I sent a validation letter and recieved a response stating it was frivoulous or irrelevant. "A consumer has previously submitted the same dispute...." 

 

This account is roughly 5 years old and It's possible I sent in a validation letter at some point. How should I go about trying to get this account validated? I'm trying to get a mortgage and don't want to wait out another 2ish years for it to clear. 

 

EDIT: I edited post to clarify my question and conform to forum guidlines.

If you are hoping to get advice about strategies for leveraging HIPAA to remove medical debt from reports, I believe that this is a topic that the mods have asked people not to discuss here.  Google, however, will certainly enable you to find places on the internet where pretty much anything is discussed.

It is unclear from the post as to whether you sent a debt validation request to them under the FDCPA, or a dispute under the FCRA of accuracy of information in your credit report.

 

If it was a dispute under the FCRA, a second or subsequent dispute that is substantially the same as a prior dispute can be dismissed without any investigation as being "frivolous or irrelevent" per the direct dispute regulations published at 16 CFR 6604. et seq.

 

If it was a DV request under the FDCPA, then there is no requirment to or period for providing any validation.

 

What exactly did you send?
