In establishing the identity theft process, congress provded a powerful tool that permits consumers to get information alleged to have resulted from identity theft blocked from their credit reports bases only on submissiion of an identitty theft report (sworn statement before a law enforcement agency).

 

However, they drew a few lines in the sand.  One such line is that if the consumer asserts no athorization for a transaction, and yet actually received goods or services as a result of such a transaction, that implies some involvement in the process.  Thus, its no longer a matter of simply soneone else benefitting from the unauthorized use.

Congress thus included the specific caveat in section 605B that if the consumer received any goods or services as a result of the alleged unauthorized use, the CRA can decline to block the information.  The intent of the statute is to grant blockage only in clear cases where the consumer is free of any issue of their potential benefit from use by another.
