Re: Early CAIVRS Removal

If you have your Ticket # or not call the 877# and ask for them to read the file (get your Ticket # at that time if you dont already have it). The person I spoke to gave me the persons name that requested the CAIVRS supression. So I just Googled his name found him on Linkedin and signed up for free, e-mailed him my Ticket # and requested to find out how much longer. He emailed me back the next day saying he had gotten notice it was suppresed and to have my lender re-run the CAIVRS check.

Hope this info helps,

Re: Early CAIVRS Removal

Also Remember to check my previous post with the link to HUD's guidlines with timeframes. This is what really helped me build my case since my lender was not in compliance with contacting HUD with in 30 days after obtaining possion of the property. (by filing a Trustee's Deed in the county) I made sure that the person at the 877# who put in my supression request referred to the Mortgagee Letter 2005-31 attachment #4 example 6.

Re: Early CAIVRS Removal

There is a different specialist assigned to each Ticket. FIRST you have to call 877-622-8525.t.... and get / write down your ticket # before you hang up.  Call back every day to check the status.     Make sure you write down names, dates, and times.

Re: Early CAIVRS Removal

You have to insist on having them file a Ticket. Print the PDF HUD Mortgagee Letter from the attment below. Find the forclosed homes Deed info on the counties web page, from when the lender 1st filed the notice of default up until the date of when the Trustee's Deed was filed into the Lenders name. Youll also be able see when or if HUD took ownership. Read, re-read, and read again the HUD Mortgagee Letter and find the mistake that your lender did. Refer to the Mortgagee Letter and be specific when insisting why you want a Ticket filed. These are HUD's guidelines and if the lender did not abide by them why should you have to pay for it. You've already paid your due's.

Re: Early CAIVRS Removal

I just joined this thread and it seems helpful!

My husband and I just found out we have a CAIVRS and are feeling very confused and overwhelmed!

Is there anyway to get some step by step info on where to start to get this removed,i have been reading through thread as much as possible?

is the email at the beginning of this thread for HUD still valid?  do we just email our request to them to have it removed?

sorry, any help is appriciated.. I did call the 800# of the CAIVRS authorization form and all they could tell me was a release date, not very helpful

My real concern  after reading this thread is that our sherriff sale was in May and from what i can tell the CAIVRS was filed in Oct (5 months later) which is within the time frame for Indiana, so do I even have a leg to stand on to ask for a removal?

Re: Early CAIVRS Removal

So after reading and re reading the HUD Mortgagee Letter 2005-30 I found that your state timeframe starts from the date the notice of defaut was filed by your lender with the County. In my county I found the info under public records. So the 5 mnths would have started from there. The examples in the ML (Mortgagee Letter) seemed to be the most informative. My lender (and it sounds like your lender as well) didn't notify HUD with in 30 days after filing/obtaining Deed to the property. I suggest that you print out the ML and really understand the guidlines in order to referr to it when calling HUD.

HUDs e-mail is still working/available but isn't like calling. Be nice but persistant when calling, and referr to the ML and ask for a Ticket to be filed.

Hope this helps,

Good Luck

Re: Early CAIVRS Removal

KarMar

Thanks so much for the quick respnse I will look that document over more closley. Our Sherriff sale was on may 21st 2013 and it was recored (US Bank took back title and possession) at the clerks office on May 31st and then the CAIVRS was filed in the system as of Oct 24th 2013, so are you saying it should have been 30days based on the may31 st date? I thought I saw in the socument that IN had up to 10 months for file the CAIVRS? Just trying to get all my facts straight before we call HUD, thanks again for all the help!!

What is the best # to call for CAIVRS issues? Also i would perfer to call them myself but I recieved an email back from HUD stating this: (is this correct)?
