This is a modification based on the divorce decree. If you make the three payments, they’ll rehab it but you should still get your own loan if possible. If you have an attorney that does assets in divorce cases, they’re the best person to discuss this with—other than a real estate (not asset structuring) attorney, of course—good luck.
