Bankruptcy Reporting

Is there a way to stop a credit union from reporting a bankruptcy that was not filed by you, but filed by your ex-spouse? They are also reporting non-payment, however I have been paying on time, everytime.

The CRAs enter public record information, such as a BK, into consumer files based on public record searches.

If you were not a party to a BK, then it should not show in your credit report.

Obtain a copy of the posted public record of the BK.  If it does not show you as a party to the BK, then file a dispute with the CRA of the accuracy of that information in your credit file.

 

Monthly delinquencies are different in that they are reported by the creditor to the CRA.

I would begin by making an informal call to the creditor and inquiring as to why they have reported a delinquency when you have not been delinquent on their account.

If it is clearly an error, they will likely correct without need for a formal dispute.

If they assert it is correct, then file a dispute with the CRA.
