Barclay dispute Experian said its not their job to look at my proof of payment.

I settled for less with Barclay's 6 months ago. They haven't updated my reports at all and I've had no success in reaching them via email or phone.

I mailed a dispute with a letter explaining they're paid, with a copy of my bank payment AND the letter from Barclays saying I've settled and owe no money.

Experian closed my dispute, says its being reported correctly. So, I called them gave them the report number and info. The guy verified they received my letter and attachments but its not their role to read and make a determination from my paperwork? They only have an obligation to send the dispute to the creditor and whatever they say goes(paraphrasing)...

Now what can I do to get this updated correctly?

File a complaint with the CFPB.

File a complaint with CFPB. Include the paperwork you have.

Explain your difficulty in getting resolution from Barclays, and agency doesn't feel it's their job to report accurate info on your report.

Thanks Is!

Is it an online complaint or do I mail my info to CFPB?

In the settlement agreement reached with each of the big-3 CRAs, stemming from civil action taken by the offices of the AG of several states, each of the big-3 CRAs have agreed to consider on the merits any supporting documents provided by the consumer submitted with a dispute.

Their response appears to decline compliance with that settlement agreement.

Following are pertinent sections from that settlement:

___________________________________________________________

IN THE MATTER OF:

Equifax Information Services LLC,

Experian Information Solutions, Inc., and

TransUnion LLC

ASSURANCE OF VOLUNTARY DISCONTINUANCE

Section II   Definitions

  1. "Supporting Dispute Documentation" shall mean a document submitted by a

consumer who has initiated a dispute, other than a document created by the consumer

or the consumer's own statement of dispute, that has some objective indication that a

party with direct involvement or authority regarding the disputed item of information

in the consumer's file has played a role in creating the document.

Section 8. Review of Supporting Dispute Documentation Submitted by Consumers

  1. Subject to Section IV(F)(8)(b) below, each CRA shall utilize a process

designed to assure that during a CRA's reinvestigation of a dispute of any

item of information contained in a consumer's file, if a consumer submits

Supporting Dispute Documentation and the CRA does not otherwise modify

the information in the manner requested by the consumer, the Supporting

Dispute Documentation shall be reviewed by an agent of the CRA with

discretion to make a determination whether to make the change requested by

the consumer on the basis of the Supporting Dispute Documentation.

  1. Notwithstanding any of the foregoing, the Supporting Dispute Documentation

review procedures detailed in this Section IV(F)(8) shall apply only with

respect to the disputes initiated with the CRAs pursuant to direct consumer

contacts as provided in the FCRA, 15 U.S.C. § 1681i(a), and the CRAs shall

not be required to employ the Supporting Dispute Documentation review

procedures with respect to disputes initiated by credit repair firms or disputes

that the CRAs reasonably determine to be frivolous or irrelevant pursuant to

15 U.S.0 § 1681i(a)(3).

THANKS! I was rather stunned the rep said that especially because I wasn't asking him to take my word for it, I submitted the payoff agreement on Barclays letterhead that had all the info verifying the account and their contact info. ??

Had same issue with Barclays couple of years ago..seems bc's attitude needs to be more consumer friendly... even if you  paid /settled  the late/ charge off account for less than full..got a lawyer  to contact their counsel...issue gone .. cfpb should get this cleared

7774x thank you for sharing. Can you possibly DM your lawyers contact info? I have struggled to find lawyers willing to get involved over such small disputes and this is a huge issue for me as it's impacting my mortgage that's in process.
