Credit Protection Agency help

I am new to the forum trying to repair my credit to buy a home. I had a Comcast account put in my name illegally while I was in Navy Boot Camp. Now Credit Protection Association is saying I owe $1,593. I have tried to dispute it but no availp. I have prepared a Full Media DV is there anything else I should do? Any help would be helpful.

Yes. I've asked Comcast for a copy of the contract and identification provided but they will not provide it. So frustrated because I've heard CPA is the worst CA out there. All I need is to raise my score 60pts to get a VA loan and Im sure a removal would help.

Contact the police if you haven't done so. Get a copy of the police report. The CRAs would delete it right a way after seeing that report.

On top of that, go to this link and fill out this form, notarize, and submit this form as well as the police report to CPA and Comcast collections department.

Just filled out the affidavit and will be filing a police report in the a.m. Should I send these forms CMRR of maybe I could fax them?

Be sure to notarize the affidavit. And yes, you could fax them. Just call CPA and Comcast.

When you assert that an account, or information under an account, entered into your CR as a result of fraud of potential identity theft, I agree that filing a police report is your first step.

Assertions are just that until backed up.  The FCRA, in section 603(q), includes a provision that permits you to put your assertion into the form of a sworn statement before a public law enforcement agency.  Such statements carry criminal penalties for knowingly false statements, and thus carry more weight that a simple assertion.

They dont require proof, just your sworn statement of your belief,  FCRA 603(q) calls such statements an "identity theft report."  Armed with such a police/identity theft report, that opens some doors to you under various provisions of the FCRA.  You can use it to block reporting of any information related to the alleged identity theft in any credit report issued by a CRA by simply sending the "identity theft report" to the CRA,  FCRA 605B.  You can put an extended fraud/identiy theft alert in your credit file, which prevents the further reporting of certain information for up to 7 years.  You can also use the "identity theft report" as some documentation of your assertion should you file a dispute of inaccurate credit reporting, either through the CRA under FCRA 611(a), or directly with the party who reported the information, under FCRA 623(a)(8).

 

The FTC has also established something they call an "Identity Theft Affidavit," which is apparently what you have used.  Just another way of putting affidavit/sworn support behind consumer allegations.  FTC Identity Theft Affidavits are not specifically recognized under the current FCRA, and acceptance of them as a form of documentation is now totally voluntary on the part of creditors,  They are good, but may not be accepted by your creditor as persuasive evidence.  Even if you use an FTC Identity Theft Affidavit, I thus still suggest you add a police report.  That is accepted under FCRA 603(q).

 

First put your assertions into a sworn police report.  Until then, your assertion carries little or no weight.

Thanks everyone. Ok so far I have contacted Comcast and they said with the affidavit and police report they will be more than willing to help. I also have military orders stating I was in training as additional proof. I am still trying to contact CPA. No luck
