DVs on old debts

I've read in these forums that once a debt gets so old a CA does not have to respond to a DV letter. Is that true? If so how old is old? What if it's a four year old debt that just now appeared on your credit report?

Age of debt has nothing to do with any requirement that a CA respond to a DV letter.

They are NEVER required to respond to a DV letter.

FDCPA 809(b) only requires that they cease active collection actiity after receipt of a DV letter until such time as they chooose to validate,  The DV process is directed towards collection activity, and not a requirement for verfifiction within any period.

I would first focus on the original creditor account, not what the CA is doing now.

What is the date of first default on the OC account that led to the collection?

FCRA 605(c) gives the date of first default on the OC account as one, single date-certain that the CA can no longer be included in your CR.

It doesnt matter, therafter, what the CA reports.  It must be delted after 7 1/2 yeras from the DOFD on the OC account.
