First Premier BBB response

Submitted BB complaint on First Premier since goodwill attempt with presidents office didn't work. Got this response from the dreaded Julie. Any advice on how to counter?

 

 

 

 

 

This letter is in response to the correspondence we received from you on January 23, 2019, January 24, 2019, and January 25, 2019. You expressed concern regarding how the above credit card account is reporting to the consumer reporting agencies and requested we provide documentation to validate the debt. 

Your account was opened in January 2016 and charged off September 2017. This account was reported as paid in full in June 2018. A charged off account normally remains on the credit report for approximately seven years from the date of charge off, even if it has been paid or settled.

First PREMIER Bank is the original creditor and not required to provide verification of debt. Furthermore, even debt collectors are only required to provide verification of a debt if you send written notice of a dispute within a 30-day period after your receipt of their initial communication. 

We confirmed that First PREMIER Bank is accurately reporting this account, including as charged off, paid in full, and disputed by consumer. Under the FCRA, when a consumer dispute is received, we must review the relevant information, and report the results. If the disputed information is found to be accurate, no changes are made. We will not remove accurate information from a credit report.

We report the very same information to the four consumer reporting agencies, but you can expect to see slight differences in how they each reflect the information since they have their own unique fields, descriptions, dates, etc. If you see these slight differences, it does not necessarily mean that information has been inaccurately reported.

Thank you.You really have nothing to counter with...About all you can do is keep trying the Goodwill route, which normally does not involve the BBB.  Search this forum for Goodwill campaings against First Premier.

If the accunt was legitimately delinquent, CRA policy instructs creditors not to delete accurate informaiton based on payment of the debt.

That means that it is difficult to even get good-will deletions.

 

Shifting from request for their good-will deletion to complaints filed with a BBB asserting improper activites on their part will usually act to promote ill rather than good will.

The basis for your complaint was apparently  demand for verification of the debt.

As stated by the creditor, credit cards are subject to normal billing statements under the FCBA, which then serve as their legal statement of the montly debt.  That is their verification.

 

Are you now requesting advise on how to contest their letter, or requesting ways to rebuild good will?

If the later, perhaps a call to "Julie" offering some basis for grant of good-will.......

Thanks for the responses. I first tried doing a dispute, then goodwill request at the presidential email others have had success with. When that failed and they responded by adding "CO" to my report for the last 12 months of history as well, I responded with the next level - the BBB dispute of accuracy as I have seen others mention success there. I wasn't aware that original creditors didn't have to validate like that, learn something new every day.

 

Seems the only option here is in fact good will.

So, last month you advocate hiring an attorney to remove charge-offs from a report. Today, you question how to hire an attorney. ???

 

To answer your question, do a Google search for attorneys in your area. 

 

If you’re planning to take your own advice and hire an attorney in an attempt to remove a legitimately reporting charge-off however, do yourself a favor and save your time and money. Throwing some legal weight at something that’s not illegal gets you no where.

Ok thanks so another question I have some lates with Wells Fargo in 2012 also in 2013 and 2015 mortgage loan. If they remove 2012. Do they remove 2013 and 2014 also. Thanks
