I have a Installment loan listed on my credit report that I paid off in 2010. However, they are reporting late payments from 11/2009 to 2/2010. I sent the OC a GW letter to remove delinquinces. They wrote back with the standard letter that they had to report accurately. I disputed with the CRA and they verified it.
What I want to know is how could I be 90-120 days late in 2009 and 2010 on an account that was paid off in 2006? I wrote the OC back asking them this question and telling them that their information with regard to delinquenices listed on my credit report is indeed inaccurate. I am waiting to hear back.
However, is there something that I can do - it doesn't seem fair or legal that a company can report delinquencies on an account that is paid in full?
Please help!
ooopss correction. The account was paid off in 10/2006. The CR shows date of last payment as 10/2006. Date of first delinquency 3/2006. And Date closed 10/2006.
However on the account history there are late payments for:
02/2010 (90 - 119 days)
01/2010 (120-149 days)
12/2009 (90-119 days)
11/2009 (60 - 89 days)
10/2009 (60-89 days)
9/2009 (30-59 days)
8/2009 (30 - 59 days)
i am going through something very similar (with a cc company) and am completely at a loss on what to do. keep me posted and good luck
I will do. I wrote a letter to the OC quoting how they said they "do not remove accurate" information in reply to my GW letter. I told them that reporting late payments in 2010 on an account that was paid in full is inaccurate and they need to remove this information. I copied the President, VP, CFO, etc. on the letter. My next step is to research the FCRA to see if I can find some specific information about this so that when I dispute with the CRA again I can quote that.

Yeah but maybe if you threaten them with suing them for wilful non compliance first will work? That is my next step if I don't get a favorable reply from the OC

Not sure? Maybe it goes with the statute of limitations on the debt? Let's both research and collaborate our efforts. I probably won't do any substantial research until tomorrow, but I will PM you with my findings and you can do the same. Together we are bound to get this solved - don't you agree? BTW what CC company is yours for?
its a fashion bug account, super silly i know, but wfnnb is killing me, lol!! experian and equifax are reporting key derogatory & repossession/foreclosure respectively with no "30", "60" "90" lates etc even though its PIF'd from last year!
I had an account with Lane Bryant that I think is with the same cc company? Anyway, they were really nice. I was extremely late and when I paid I asked them if they would help me out by removing the delinquent information and they did. Did you call or do a GW letter? This was way before I started my fico so I don't have the person I talked to but if you PM more information I may be able to dig something up for you.
