Harvard Collection

I sent harvard collections a dispute requesting a DV letter on Jan 22. Sprint told me the debt was in 1999, however Harvard is reporting it 2003. They have not responded to my DV. I sent one to the CRA. Harvard collections has not resonded to my request, however they responded to the CRA request. They are asking me to send information to support my dispute. How should I respond to this. They are requesting that I send this information to their office by March 14.  Any advise.
Thanks

Harvard or the CRA wants you to send information?

If Harvard, you don't have to send them anything, they have to send you something.

Re: Harvard Collection

Harvard baught a book of Sprint accounts and has been bombing people's CR's without any notice of any kind lately. This is a violation and I personally just had a lawyer draft an demand/ITS letter to them. They will not respond to a DV guaranteed because they are a JDB and they are falsley reaging accounts and doing this to A LOT of people in the hopes of extorting money from them. Keep at it and log each and every violation. How did they request info from you? Did they send a letter or just have the CRA ask for it in the dispute results? I personally didn't even get an f-you from them when I sent a DV.

Re: Harvard Collection

Yea this is what happened to my mom,  i would have DV'ed them but she has credit repair specialist working with her which is so lame now that i have found this place. They just placed this account for collections without notice or anything!

I want to DV them so bad whether it helps or not!

Re: Harvard Collection

Re: Harvard Collection

So as you all know i DV'd Harvard Collections and i believe i used the Lonnster DV letter. Now my question is since i used that letter i believe a  part said all collection activities must cease until validated, not really sure i will have to look it over. Anyway Harvard Collection has updated as reporting this month 5/08 would that be considered a violation, if i stated in my letter cease collection activity until validated?

RE: Account #_________/Original Creditor’s Name

Dear CRA:

This is a request for deletion of a disputed item. I have attempted to have this allleged debt
verified by the alleged creditor and collection agency to no avail. I am respectfully requesting that
"Collection Agency" do what is legally mandated by the FCRA and FDCPA, and delete the account listing.

Name of Creditor/Agency, Account #_________

On XX XX 08, "Collection Agency" received a demand for validation from me. Attached is a copy of that letter along with the U.S. Post Office return receipt showing they did indeed receive the request.

As of today, XX XX 2008, they have failed to provide any proof or respond in any way.
On XX XX 08, I sent a second letter. Again, I have received no response. Attached is a copy of the
letter and the U.S. Post Office showing they did receive that letter.

The FDCPA states they must cease collection activity until they have produced verification of the
alleged debt if so requested. As per the FTC, this includes reporting to the credit bureaus, which
they obviously have done illegally. It is quite evident that no such proof of this alleged debt exists
or they would have provided it in the previous X months since it was requested.

Also, when an alleged debt is disputed, a notation must be entered on the debtors report showing the
item as in dispute. Again, this was not done. Another violation of the FDCPA. (DELETE THIS PARAGRAPH IF IT DOES NOT APPLY!!)

As per the FCRA, if no proof of debt exists, it may not be reported to the credit reporting bureaus.
The FCRA also states that the credit reporting agencies must accept written proof from the debtor.
Therefore, I am not asking for an investigation to be done, I am requesting that the entry be deleted
in its entirety as there is no proof of its existence as evidenced by my attached documented proof.
Sincerely,

Your Name

Re: Harvard Collection

If the CA responds to your DV asking for info. NO  their 30 days are up IMO!

They have 30 days to respond......If within that time you receive a letter asking for info from you or saying that they are checking with the OC......I would take that as  they do not have validation!

Re: Harvard Collection

HappyDays,

YOU ROCK!  Much love to you for this wonderful letter!  I was looking for something for my husband, but I will use this letter for myself.  I have a collection account on my credit report from Nationwide.  I can't get rid of it for nothing in the world.

This is awesome.
