I can't find the answer to this question...

I thought I saw it here somewhere, but i've been searching for an hour and cannot find it. I am looking at my DH's Credit Report. There is a negative on there from First Premier in the amount of $568. There are also TWO from Arrow on there that show that same amount as the *High Balance*. I'm sure all three of these are the same thing, so we're going to go ahead and pay Arrow, but will that delete the First Premier entry..or actually show it as being paid, not delete it (unless we try PFD)..should the First Premier even be on there since they've given it over to Arrow? How should we get First Premier to remove that? Or can we?

No Brownee!  Do not pay them!  Arrow has been in an awful lot of trouble these days and they have been caving on DV's.  Go ahead an DV them and I bet my last chicken finger they delete from the credit bureaus.

First DV Arrow.

Second, even if Arrow validates and you offer a PFD, it will only get rid of Arrow. FP will still be there. If FP SOLD this account it should be reporting as a zero balance. Either way, Arrow should only be listed ONE time for this account and not twice.

Have you contacted FP to ask them if you can PFD or if they even still own the account? It is always better to work with the OC if you can.

Re: I can't find the answer to this question...

Ok, so you're saying to send Arrow a letter asking them to verify that the debt is even owed by DH? Then when they can't find it, or whatever, they'll just take it off? That can happen? I mean, we don't want to NOT pay the debt..we have budgeted it to pay it cause it IS our debt. I just want to be sure that when we do pay it, all of these excess entires will go away.

I guess i'll have DH call FP and ask them if it's been sold and if so to let the Credit Bureau's know..right?

Send the DV letter below to Arrow. Sure, DH can call FP and find out the status. But if Arrow does validate, then atleast you have the money to offer a PFD. Still in all, it does not get rid of the FP unless you can somehow GW it off. That entry will remain since on charge off accounts the OC and CA can both report. That is why going to the OC to offer payment and to get a delete if possible is better. They also have the power to pull it away from the CA.

If FP is still reporting a balance, it is very possible that they still own it. If not though, then DH will need to dispute with the CRA's as the balance would be incorrect. (should be zero if sold)

Re: Debt Collection Company Name; Acct # Debt Collection Company #; Original Creditor Name; OC Acct #

To Whom It May Concern:
This letter is being sent to you in response to a notice sent to me on DATE. Be advised that this is a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is NOT a request for “verification” or proof of my mailing address, but a request for FULL MEDIA VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that (a) the account is valid, (b) the amount allegedly owed is accurate, and (c) I have a contractual obligation to pay Debt Collection Company Name for this alleged debt.
All of the following MUST be provided to adequately validate the authenticity of the alleged debt AND provide proof of my contractual obligation to Debt Collection Company Name for this alleged debt:
• Signed credit application between myself and the original creditor
• Copies of all signed vouchers from the date account was opened until default
• Copies of all statements from the date account opened until default

If you can NOT validate your claim, you can NOT, by law, collect on it, or SELL it to another collection agency. Also, reporting a debt to the credit reporting agencies that can not be validated is a violation of the FCRA (Fair Credit Reporting Act), and carries a $2500 fine to be paid to me. I have two years to decide if I want to pursue this matter. PLEASE GIVE THIS MATTER THE ATTENTION IT DESERVES.
If your offices are able to provide all of the validating media as requested, I will require at least 30 days to investigate this information, and during such time, all collection activity must cease and desist.
I am also stating, in writing, that no telephone contact be made by your offices. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment, and I will have no choice but to file suit. You may also want to mention in your letter that reporting the same debt multiple times is a FCRA violation
