*sigh* this is really really frustrating! should i pay first or just write to the legal department and say "hey, i'll pay you, but can you do a motion to vacate judgement?"
The plaintiff doesn't usually file the motion to vacate, they have no reason to.
They don't care if it is vacated or not. Courts have already said that you owe it and they can just go back and garnish wages if you don't pay.
You could talk to them and see if they would contest it if you were to file a motion to vacate.
Call the courthouse it was filed in and ask them what "proper service" is.
