Medical Collection Questions

OK the only bad thing I have left on my credit report is a collection from a hospital visit. I went to the hospital in October 2005 no insurance etc and couldnt pay. They then of corse sent it to collections. The collection account on my report is for the full amount of $527.00 and was opened on 02/08 2 years and 4 months after my visit. I am thinking it could have been sold a couple times or what not I am not sure. I just started monitoring my credit and caught this and am trying to get it fixed. I tried dealing with both the collection agency and the hospital and both gave me the run around. Shouldnt this have already dropped off my report? The original date of service was 10/05. I am just not understanding why it wasnt reported in collections until 08. I also have no proof that in 05 was when I recicved services however I am positive of the month and year.... Anything I can do about this? Any help would be appriciated.

I never dealt with medical collections but I'm dealing with other ones. And what I learned that I have the right to request a debt validation. And that if I'm 100% positive that the information is incorrect but just send them request to remove information because they are violationg FDCPA rules and bla bla bla. That if they will not respond within 30 days further actions will be taken. 

Collection agency is not a law firm and they are not laywers. So if they are not sure what to do they will just delete the information because it's easier. 

 

But please note: I'm not a lawyer. I do a lot of research before I take any actions. This is just an exapmle of what can be done when you positive that you are right.

This is a case of re-aging the debt, it should have already been excluded from your reports.  You need to send a direct dispute to them with this information.

By send a dispute directly to them do you mean the credit reporting agency (I am assuming that's what you mean just want to be sure).

Yes, and file a complaint with the CFPB for re-aging the debt.  The CA set the DoFD as when they got the collection, not when it went in arrears from the OC as it should have been.

+1. I read your post wrong.  file with the collection company.  The CRA only reports what they are given by the CA, so the CA is at fault for not providing correct information.  Thanks for catching that Eric.

Ok thanks... I iwill try to get in contact with the CA. I have had issues with this in the past with trying to deal with them and the original creditor... I wonder if I shouldnt just leave it alone and wait for it to drop..

Ok I have one other question. If I contact the CA can it somehow restart the 7 year clock? I am trying to figure all this out. My Experian report says it is due to fall off in October of this year which would be older then the 2008 date they started reporting which makes me think it has been re aged twice maybe by two differnt companies? I am not sure. I am positive it is from a visit in Oct 2005 like I said. I havent had any other medical bills not taken care of (that I know about) since then. Really not sure how to go about this now.. I dont want to somehow reset the clock on it.
