OK well our journey has started and wow:
I pulled her free yrly credit report. 90% are all medical collections ranging from 10.00 and upward of 400.00. Majority are 100 or less.
Looking at the CR I can the CA account number but inorder for her to pay the OC for a 35.00 bill how will she know what account number to put on the bank money order?
She is digging for any bills but has moved 8 times in 5 yrs so you know its a fat chance she has them :-)
Next question. I know its best to pay the OC and not the CA, and is it in her best interest to send a hipaa letter as well and no contact with CA. Am I thinking along the correct lines?
Ok SOL for Arkansas. If medical is a written contract and from what I can find a SOL on that would be 6yrs for our state.
Several are due to Fall off between Jan and July of this yr. Do we tackle them first or longer term ones and hope the others fall off and be able to take care of them afterwards. They are still her debt and she still owes them but with so many I am trying to figure out which way to take her down this road.
Smallest debts first or ?? we are looking at 35 medical debts.
Thanks in advance !!!
Actually, Arkansas is one of the few states that has an actual SOL for medical debt. It is 2 years from date of service or the date of last partial payment.
We can't discuss the HIPAA process here, you'll need to look that up online.
Just paying the bills will not remove them from the CR. Since they are more than likely beyond the suing SOL, do a PFD. They have nothing to lose tor such small amounts.
Thanks where do I find the information on the 2yr SOL? This is great news!! I have the hipaa info , just mainly was needing to know since she probally cant find OC billing with original account number and CA probally has thier own account number assigned, which way, how should she best document on the payment to assure they are crediting it to the correct bill?
Should I have her include a copy of that section of the credit report so they also know which CA has her Account?
and they can see service date etc?
Or should I have her just write that info in and not include a section of the credit report?
Thanks!
Ok I went looking on line for the 2 yr information.
This is what I got off a actual CA website offering thier services:
Following is some important information on Arkansas state debt recovery laws including: Arkansas Statutes, Arkansas Judgments, Arkansas Garnishments, Arkansas Interest Rates, and Arkansas Bad Check Laws. |
STATE: ARKANSAS Interest Rate
STATUTE OF LIMITATIONS (IN YEARS)
|
I live in Arkansas so I knew what the SOL was. Google medical SOL in AR and it will come up.
If the debt is out of SOL you can send the CA a DV letter. Specifically ask who the OC is.. They will need to give you that information.
Are all of the 35 accounts with a CA or any of them with the OC?
Where did you pull the reports from?
Pulled reports from annualcreditreport dot com
We are still sorting :-)
Now that you know the SOL is expired, try to get the best bang for your buck. Send the PFDs, but try to get a discount. I'd start at around 25% and go from there.
Heres a Copy/Paste
Theres 12 of these Same account number with last numbers XXed of so cant tell much from that and all are for the same exact date but if Medical Here in Arkansa is 2yrs look at the date to fall off.
No Idea when DOFD is. Can assume 180 days priors but cant confirm because we have no original paperwork or anything from this CA. So do I stil have her PFD? Is it really past SOL?

The fall off date and suing SOL have nothing to do with one another.
It does show who the OC was so she can call them to find out the date of service.
It was placed for collections 5/2007 so it is well beyond the state SOL. You can figure approximate DoFD by subtracting 7 years plus 180 days from the fall off date. That would put it around 1/2006. If that's the case, it wasn't reported for collection for over a year.
I think I would try the PFD route at this point.
For the other 12 reporting, is it the same account, amount and everything?
