New Collection Item...2 weeks away from closing Escrow :(

So when you are buying a house new collectors creep out of nowhere.

 

I received a dunnung letter a few days ago Dated June 25th from NCA (Junk Debt Buyer)  stating they bought an old HSBC account that was charged off years ago. I have 30 days to ask for validation Blah Blah Blah!!

 

Well I sent the DV letter CMMR a few days ago went out late 7/2/09. I am pretty sure they have not received it yet. But today I see this on CCT.

 

I have a few concerns. 

 

1. Opening Date: 6/22/09 This is before the dunning letter date is this a Violation of FDCPA??

2. Balance is 940.00 The Dunning letter states 937.00 the debt hasnt been validated

 

I was under the impression that during the 30 day period you have to dispute the would not report anything until they have validated the dept if you request it or the 30 day period is over.

Hi, GliGuy23 unfortunately I have read through many threads if you are about to apply for a mortgage you need to opt out with the credit bureaus as these collection agencies come out of the woodwork to harrass people.

How old is your charge off and I would see if you can do a pfd.  Good Luck

Sorry for my late reply. I was under the impression I would get a email on my Blackberry if anyone replied. Obviously I was wrong.

I was under the impression that opting out was to prevent pre-approval letters etc.. from coming in the mail. I know that loan officers recommend that I think a few Loan officers on here have said that there are utilities they subscribe to that trigger an alert when one of their collectees does a mortgage pull. Since I have applied someone has tried sueing\tried getting a judgement which they failed to get after I hired an attorney and now this collector that actually reported on my credit report.

The Charge off is from 2005 so i woul say it is not beyond CRTP.

Everything I have done is on the boards and with help of others. DVing stuff and PFD work really well. I am going to talk to my LO and see what she recommends. They said I was good as far as credit pulls went for 60 days as of May 28th closing date is the July 17th so were cutting it close. We will see what they recommend. 

 

If worse comes to worse I will try PFD.
