I just called Experian to have to paid off charged off accounts removed from my Experian report under the NYS 5 year early purge law.
The customer service representative I spoke to said that they had to open a dispute to do this and would specify that I'm looking for early exclusion under this law.
I was hesitant and repeated multiple times on the call that I am not disputing the validity of the delinquincies or charged off accounts and they insisted that this was part of the process.
The person I spoke to said that this would be processed and the charged off accounts should be removed in a few days.
I got the persons name and wrote down the time of the call just in case there are any issues but can anybody confirm whether or not that a dispute is the first step of the process?
Not addressing the NY 5 Year issue directly, but to my knowledge all early removal requests for the TU/EQ/EX go through the dispute process.
Get to their "Other" dispute category first.
Then they all pop up a text box for you to enter your request.
I used: "Not a dispute. Requesting early removal due to age and status. Thank you for your consideration"
TU removed both immediately. EQ removed one, the other wasn't on their report. EX is still processing.
If your NY statute is applicable, I'd insert that instead of "age and status" and it should work.
But you will have to use their dispute process even though you're not really disputing the debt, only it's presence on your report.
Thanks for confirming. Was a little worried.
When the woman was on the phone filing the dispute I asked her to include the specific language that I was requesting my charged off accounts that have been paid in full are removed from my credit report in accordance with the new york state 5 year early exclusion law, which she read back to me before submitting.
Exact same process I did with my charge off TU and EQ were super easy one phone call I had to play recorded the call for my record to have proof that they are agreeing over the phone to remove it and within a day or so was gone. EX was more difficult for some reason the reps kept saying they didn't know about that and blah blah blah eventually got a rep who knew exactly what I was talking about and proceeded it after my request.
