Hello-
So, I am doing everything in my power to fix my credit--have sent out letters as well as making phone calls about things on my credit report that are NOT correct. But the CRAs keep responding that they have contacted the creditors before and are reporting it as accurate...I am in this circl and nothing is getting fixed! Any help? Suggestions?
Thanks.
If you believe they don't want to delete incorrect information you can take them to court.
Other than that, and in the absence of more details about your specific situation it is hard to provide any type of suggestions.
What type of debt, who's reporting, how long you have been dealing with this, what specific steps have you taken, etc., etc. would be useful to understand what's going on.
Start reading all the sticky threads in this forum, then see if you want to share some more information, and maybe someone can reccommend something.
Specifically--I have student loans with Nelnet. About 3.5 years ago they were put into forbearance as I was not in school BUT did not have the means to make the payments--so I spoke with one of their customer service agents about the situation and they assured me that the loans would NOT show up as past due but the forbearance would kick in and it would simply show as being in forbearance. It never occured to me that this would NOT happen;however, it did not report as being in forbearance when they said it would and did INDEED show up as 90 days past due! I have called them personally (Nelnet) a few months ago and they said they could do nothing about it. So, I have disputed it with the CRAs and they will do nothing about it as Nelnet is reporting it as correct. I feel like I'm stuck! This is so frustrating.
The other company I am dealing with is HSBC--A cc I had through them went into default almost 4 years ago and was sold to a collection agency--it has since been paid in full. However, HSBC is still reporting on my CRs--stating the account was sold--I just want them to delete the entry, but they refer me to the collection agency. I just want the entry deleted. No luck.
So, that's what I am currently dealing with. And on top of things I just found out today some collection agency is trying to serve me papers. Not sure what to do to avoid a judgment as I have no large sums put away for this--I'm in school and trying to pay off all this debt. Any suggestoins on that part would be helpful, too. I'm trying to do the right thing and pay this stuff off, but my credit score seems to be dropping again and I haven't done anything that should cause that. I feel like I'm going crazy with this!
Seriously, any help is much needed--as I need to take out private student loans next year and can not do so until my credit goes up a LOT more--so frustrated.
I don't know too much about SLs, but HSBC is reporting correctly. They can remain for 7 yrs past DOFD. After 7 yrs, the account will either delete or revert to a good, closed account. You could always GW to get it removed. Though I do understand HSBC is tough to deal with.
Were the SL not put in forbearance as they were supposed to be or were they put in forbearance but just reported late when they shouldn't have been?
If they were indeed put in forbearance, get a letter from the company stating when the loans went into forbearance and when they came out. You can send that letter to the CRA with a letter from yourself that states that the FCRA requires the CRA to consider information provided by the consumer when doing a dispute.
If the loans were never put in forbearance, then they are reporting correctly and your problem is with the company not the CRA.
As said, HSBC can report and is reporting correctly, if they sold the account. All you can do is GW.
Do you know which CA is suing you and for what debt? If you do, find out your SOL. Also, don't run from it, you might end up with a default judgment.
