Yeah, this sounds suspiciously like a few scammer calls I've gotten. They threaten to show up at my work or home with a court summons, but can never seem to give me any legitimate information about their "case." There's a known scam going around right now that uses scare tactics to get people to pay. When they called me, they claimed I owed a payday loan (I don't) and they had a LOT of information about me, including my name, address, social security number, etc. 

 

I told them I'd gladly await their "summons" but they weren't getting a dime out of me for a debt that I 1. don't owe and 2. they can't verify. They hung up, and haven't called again since then. 

 

Surprise, surprise...no summons ever appeared. Smiley Wink

Thanks, sure looks like it to me.

 

I am seeing multiple "firm" names as well... Unfortionately it is hard to sue someone you can't track down yourself because they won't identify who they really are.

 

Still having issues figuring out what game plan is here, at what point do they try to get me to pay for something lol.   It seems they are trying to build up all kinds of fear (need to serve documents, calling my HR department) so that when they offer to settle this debt I don't have I'll be like ohh yea, lets do that now.

Was just thinking... Can you imagine being one of these people who makes these illegal and scam calls?   They must be charming individuals...  I wonder if they just punch a clock or if these people actually reap the profits from the people they get to pay up.

Thanks for posting this, there seems to be an increased number of scams like this one being reported recently.

 

The one thing that tipped me off was that they called you and your HR telling them a garnishment letter is on its way. Nobody does that Smiley Happy

If they have won a judgement against you and they have the authority to garnish your wages, they would only need to send the authorization to your HR, not to you

That is a good point, I was wondering about whether a call to HR was normal, seemed unnecessary and something that would only be used as a scare tactic.   I did run checks for any judgements in the past two states I've lived in just in case, all clear.  I will keep posting as this train wreck continues.

Wow. I would be SOOOOO pissed if they called my place of employment. I know it's a random scam but I do wish these people would be caught.

I would also second RobertEG's suggestion to mail copies of those letters to the CFPB so they can be stopped and jailed

I would call them again and inform them that after turning over the recordings of their calls - including the one given to you by your HR department - to your attorney, he has requested their physical address where he can send the summons for the FDCPA violation suit he is preparing to file.

I have considered calling them again, but as of right now it has been silent since they called my HR department... I think I'm going to sit it out for a little longer to see if they make another move.

It was one name in your original post and a second one later on.   The amount they are claiming (even inflated) is not that big to support two law firms, and the CAs.

 

Actually, I did have a legal wage garnishment without a judgement or papers served once.

 

It was from the IRS and at that time, I was working for a government agency.  They had sent notices by certified mail over a few months and I had a Tax Compliance Agency working on my problems and had notified the IRS over 60 days earlier that they were preparing the necessary forms and would be representing me.  The IRS said it had gone on long enough and just garnished 385 out of my bi-weekly check.  It took about 6 weeks to get it removed.  Apparently, there is a 'rule' that the IRS can garnish wages quickly if you are a government employee.  

 

Of course, we all know that in the eyes of the IRS, you are Guilty until proved innocent.

 

After about 6 weeks, they removed the garnishment and approved a monthly payment plan.  I was livid because they already had my IRS forms for about 4 weeks when they did the action.  It was a matter of working thru their backlog.  Eventually, I was exonerated and after they took those big chunks out of my wages, I owed very little.

 

GL wiith this and keep us informed.  Does the HR department have anything concrete that can be used against them?
