You don't have to wait if you can PIF if they validate.  If you can't it would be advisable not to send a DV because they may sue.


At the present moment I do not have the full amount. Since the DoFD is 10/2009, would I have to wait till October or November to be able to DV? I just want to be absolutely sure before I wake them up fully, so to speak. Sorry if I am asking a lot, but I do appreciate your help!

I would wait until January 2014 just to be safe. Then it's passed SOL for sure.

Depending on your state, their SOL can be longer than the CRTP.  Your suing SOL starts with the DoFD.   If your SOL is 4 years it won't expired until 10/2013.  So I would wait.

 

As far as the CRTP, the DoFD is 10/2009 which means this can report, at a minimum, until 10/2016.

It wouldn't be over until the end of the month if it is 4 years.  That would make it Oct 1st.

Thank you to all of you for helping to clarify the DoFD question. I will be patient and wait till around January to proceed forward on this. Thankfully I am in a position where I don't need it immediately off or soon, for that matter. I hope you all have a great weekend!
