Update 6/16:

Pros: I am able to open a checking and savings account with Unitus. Woohoo! Even though Chexsystems wasn't updated, I had proof from my CR and a bank statement stating how the CO was paid, and I was okay'd! Now to just gather up the $65 to open it! ($10 member fee +$5 share to remain in savings + $50 deposit which is immediately able to be withdrawn.)

Cons: I have still not received an email in return from the one sent four days ago... I'm becoming discouraged. I don't think I'll get lucky and pay less than half. Really wish I had known the SOL on my debt; I would have offered less than 100% the first time! I'll wait until Thursday for a response, but I'm doubtful. If I get no response, I guess I'll be sending a money order to CMRE next week. Although I probably would be doing that anyways, I would rather only pay $150 vs. the $385... *sigh*

Send them another email. Can't hurt. Also, I am assuming that if you just sent in the 385 they would just changed the TL to settled, instead of PFD. Or did they tell you 385 in exchange for removal?

They didn't tell me anything. Just the same letter as before, with the amount and due date changed. This is what the letter said that responded to my PFD:

"The purpose of this correspondence is to re-confirm our agreed upon payment commitment. The terms of our agreement are as follows:

Payment amount: $50.00

Due Date: 06/30/2014

If you anticipate problems keeping this agreement or require additional assistance, please to not hesitate to give us a call at (800) XXX-XXXX during our hours of operation Monday - Friday from 8:00am until 5:30 pm Pacific Standard Time.

Thank you for your prompt response.

Rep Name, Ext XXX

Collections Account Rep."

Then at the bottom it says for my convenience I can pay with Visa, MC, Amex, Discover, WU Quick COllect, personal check or money order.

[EDIT] Also, I asked for a payment plan, which they obviously saw, for $50 a month until it's paid off.

Yeah, it doesn't look like they are going to remove the derog from your CR if you pay per the above. I would write them and ask for PFD confirmation. I didn't know that this has been agreed on. If you have already agreed to pay the CA 385, it's very hard to go back and ask for much less AND a PFD. Most CAs won't do a payment plan with PFD either. If they agree to a PFD for 385, can you pay the whole thing immediately?

Re: Email to collections specialist and possible GWing soon

I have NOT agreed, that is just the wording they used. When I called (being dumb before I really got knowledge from the forum) I asked for the current info. They asked if I could pay, I said no, gave them no information, did not say I would be paying any time soon, as I am unemployed. My PFD specifically stated that I would not agree to pay anything unless they agree in writing to a deletion upon receipt and clearance of the last payment.

And no, I cannot pay the full $385 immediately. I am not working right now, and won't be for at least 3-4 months, so I can really only afford $50 per month. But this is outside the SOL so I am not worried about being sued, so much as getting it off my reports.

Got it. Well, send them something back confirming that you have not agreed to pay, etc but that you would like to PFD. Keep at it, good luck!

Send something back by snail mail or email? Also, should I send it directly to the rep again if I snail mail? I've been sending my letters c/o CMRE to the rep specifically.

Snail mail or email. I usually sent email because I was impatient. Ask the rep about PFD. Still, many companies won't do a payment plan for PFD.

Re: Email to collections specialist and possible GWing soon

Alright. I'll send an email because that'll go faster than snail mail... especially when they wait 2-3 weeks to respond at all. :/

Thanks Newguy, and I'll keep updating with what happens. Smiley Happy I'm sure I'll be needing more advice as I go lmao.

Re: Email to collections specialist and possible GWing soon

I have a student loan that's a little less than one of the debts you can't pay and are letting it just fall off.

I wish I could let my student loan fall off. lol. I definitely can't pay  $46k either, but the student loan remains.

Funny how things are.

I'm sorry that you feel bitter about your situation, but honestly, I sense hostility in this message, as I have seen in other messages from you to other members. Yes, I am letting this fall off, since it will be falling off within a year, anyways. Yes, I will settle it eventually, after I begin to work again and save up a settlement amount. But it was from an emergency hospital stay due to appendicitis and other sudden health factors associated with the surgery. Not from taking out a loan. Yes, I have a responsibility to pay this debt, and I know that, but I did not borrow money and incur this debt.

Perhaps this is why I can let my $46K medical debt fall off, while you cannot let your $46K loan debt fall off.

Not trying to be mean, but this seems like it was an attack on myself to make yourself feel better, and that's not really fair. I was trying to give you honest advice on how you can try to make yourself extra money to help you, as my family has had to do over the last year, and is still doing. I don't try to bash people with their decisions. I try to help them. If all you are willing to do is seek me out this way after a good-willed attempt to help you, then please, do not speak with me or on my posts, anymore. I will no longer contact you or speak on your posts, either. If I am in fact wrong, I'm sorry that I took it in such a way, but that is how the message came across.
