In 2006, I had voluntarily had my car repossessed as I could no longer afford it. This debt has apparently been sold(it is out of SOL for my state). I do not see any new collections on my CRs, but my answering machine has been collecting messages daily from some CA. I assume it is this debt that has been sold off, but have never received anything in the mail(same address since the repo). Should I have received dunning first prior to the phone calls?? This TL is due to fall off this year. Any advice?? Whoever the CA is, they do not leave any info on the messages.
You should have received a dunning notice within 5 days of them contacting you.
What is the DoFD?
never received any thing in the mail about this. DOFD is around 07/06.
As I mentioned, this has to be the auto loan someone is calling about. It is the only old baddie I have lingering around out there. the OC, ROADLOANS, changed their reporting to CRBs to an "OK" as of 2/09, which may be when they had sold the debt.
If you are sure it is out of SOL send them a DV letter.
DV letter would be the way to go. You should receive a dunning letter within 5 days of contact, if not then this would be a violation.
