My wife was just sued in a civil complaint by Midland Funding LLC for a GE Money Bank Sams Club debt from a couple of years ago. We had moved from Florida to Pa when the bubble burst and both of us found ourselves unemployed at one point. Something had to give and we got buried with 2 chase cards, our Sams Club Card and one for Furniture Row. We managed to keep up a couple of other cards but these others we just couldn't handle and ended up in default. Since then, and this was about 2.5 years ago, we've both found decent jobs and can pay all of our bills on time. We really don't have a lot of room to make additional debt payments so we've been ignoring a lot of calls.
The suit is for $4187 and that is money we just don't have. Should we call them and try to get a reasonable payment plan? Any suggestions?
I would call them because the most they can say is not. Trying to work something out before a judgment results will be best for your FICO if that is a concern.
I'll be calling them soon but I'd like to get my ducks somewhat in a row first, as I don't even know what to tell them. I guess the first thing I have to do is check to see if this civil complaint is real because from what I've read, they're known for falsifying complaints.
If I contacted GEMB and made an offer to them, would that override Midland?

It all depends if GEMB is willing to take it some OC do while others refer you to the CA. I have made deals with both and the results are usually the same.
No matter what you do - GO TO COURT.
When i got slapped w/ judgment papers the CA let me make payments to prevent garnishment, but they did put the judgment on my credit reports, obviously.
