Problems with Collection agencies

I have several collections, that I have finally started working on. The problem is, several of them using second and third partys to collect for them. Here is an example:

 

1. I had a First Premier card charge off in 2004. The debt was sold to Arrow Financial services. I am getting hassled at home and work for the debt by Capitol Management Services. Arrow is the one that is reporting on my CR.

 

2. I have a collection with Midland Credit Mgmt for a Tribute Mastercard in 2005. Midland reports to the CRA, but the company persuing me is Enhanced Recovery Services.

 

 

My other problem is what I need to do next. I have another collection with AFNI for a T-mobile account. It went default in 2002. Can they still be messing with me 7 years later? My credit report shows that it went bad in 2007.

 

Next month I had set enough money aside to start DVing people and doing PFD's. But I'm not sure who I would send them to, and if they would even ablige me a deletion.

 

Side note, I think all of my collections except one, are out of SOL for Kansas. I have a collection with Paragonway for a Check N Go pay day loan, from 2005.

I have a collection with AFNI for AT&T from 2004. I have another collection with Harvard Collections for Sprint, from 2006.

 

Any ideas Fico guru's?

If you have the money to cover the debts (or if the debts are past SOL), ALWAYS send DV letters to the CAs who are reporting first. Do not dispute with the CRAs or send PFD letters to the CAs, at least not yet.

The federal SOL on all phones is 2 years from DOFD. federal law always trumps state.

 

First premier is the OC and can not be changed!

 

Look at the 2 CAs reporting for the open date. That would be the original CA assigned or bought the account. Only 1 CA can report!

 

Is premier reporting? If so what is the drop date reported?   The CO date has to be later then the DOFD.

 

Mail both of them a DV  CMRRR  use the account # that is on your CR. For Arrow answer the call & ask for their addy. Make like you will mail them a check.  Also mail the past SOL letter with the DV.

 

T-Mobile....should delete this year. You can mail them a DV along with the past SOL letter....CMRRR

 

Pay day loan....check to see if your state has special laws dealing with this.

 

All collections must delete 7 - 7.5 years from DOFD not CO date. The OC sets the DOFD.

 

You can call the phone company and see when you made your last payment and ask for the last 3 bills to be mailed to you.

 

DVs are always mailed to the addy on your CR UNLESS it is not reporting and you get a call or letter.

 

Do not think of a PFD until the CA answers the DV. When past SOL it is easier to get them to accept a PFD.(only if they own the account)  IF the account is owned by the OC.....try to get them to pull the assignment from the CA. (in writing only)

January 05 is your DOFD.  So....Jan 2012 is the drop off date for this acct.

 

SOL - Statute of Limitations.  Let them know this acct has gone FAR past Fed SOL and must be removed.

   You can search the forums (or even google) for examples of SOL letters.  Just be sure to include relevant acct #'s & such.  (no signature)

 

DV all except the OC.  And never sign these....Type name only

Also, Arrow is not calling me.....it's there underlings Capitol Mgmt.

 

T-Mobile and Sprint aren't actually on my reports anywhere, but they are on there under AFNI. It says T-mobile will delete in 2016. (remember, I haven't had this account since 2002)
