I am new to this forum and I have a question that is kind of complicated. I purchased a car in 2002 with a 60 month loan. I was never late on my payments. The car was financed through a finance company that was owned by the dealership. The car was a nightmare. Within 6 months the transmission needed to be rebuilt for $1,800. I paid for that. Then about a year after I purchased the car the engine blew. The repair was appox $5,000. I called the lender and told them I intended to get a lawyer and sue. I assumed they knew something about the car that they didn't disclose to me when they sold it. The truth was it was a bluff on my part but. Well.... They paid to have the car repaired! They paid the repair shop directly. I never signed anything. I don't even know what the repair bill was. To me it seemed like warranty work. During the course of the loan I requested a statement from the lender every few months. I just wanted to check the balance etc... The amount due always made sense to me. After 60 months I paid the car off and waited for the title. The refused to send it. They said I owed appox $6,000! I asked for a detailed statement but they have refused to send one. They said the payments could be a combination of late charges, interest etc... They actually sent someone out to reposes the car but the car is not here. Collection calls etc... Now they are reporting to the CA that it is a charge-off but the amount they are showing is $550. They report it as 120 days late every month. Of course that is killing my scores. I'm thinking of going to small claims court. Any ideas would be appreciated!
