Thats really terrible what some car dealers can get away with and how they take advantage of people in need. The first car loan I got was from a shady car dealer with similar morals. The finance guy did however tell me very clear that if I was late on a payment especially the first they would come get it right away. Happy he told me very seriously sobered me up and I understood to make it my priority.

If you're saying you've never, ever been late with any payment for anything you are a rare case indeed. In fact you'll be the only person I've ever seen who has made such a claim.

The issue was never WHY the OP was late.  It happened.  It's water under the bridge.  Knowing the exact reason doesn't help the OP - it only feeds the curiosity of others.

Sorry, I was only inquiring based on the fact the down payment was so large. If it was financial issues then I wa thinking maybe the down payment should not have been so large. 

 

In any case. The whole situation sucks and its terrible that a dealer would do such a horrible thing.

 

In San Diego we have a reporter who unearths shady businesses and such. Is there anything like that there? I think this is the guy locally. Maybe he can point you in the direction of someone like that there.

It's being legally reviewed now. We're just waiting.

 

Didn't think payment was due for another 5 days. When the vehicle was financed dealer verbally agreed to extended the due date 5 calendar days. Dealer said no problem we'll make your installment start on the following Wednesday not Friday. Wednesday was requested as first installment since that was the day salary was paid however not reflected on paperwork was verbal. Tried to pay once it was repo'd but dealer refused to accept payment at that point. May have been a planned setup. Dealer says, what, what, don't know what you're talking about. You were told the installment started on Friday and you were late. Why didn't anyone call? Dealer said we don't have to notofy you if your late, vehicle becomes ours to take. But there's no proof of the verbal installment date on Wednesday so it doesn't apply and I didn't include here. Everything feels like a shady setup. They seemed like nice honest family owned dealership at the time. Heh. So on verbal payment was going to be made on Wednesday but the vehicle was already gone. There were multiple people involved, everyone heard the start date of Wednesday. But now everyone says Friday was the agreed start of the installments. Misunderstanding? Ok, here, take my payment right now (Monday). No you're late based on the paperwork, vehicle is ours. Pay in full or walk away. Then they said we have been doing this for 30 years, we can. Sue us they said.

 

It gets better. They gave 10 days before all rights to pay in full expires and all rights to the vehicle were lost. Based on that as of Tuesday (today) the vehicle is completely lost..... option to refinance - gone. They weren't going to give the vehicle back regardless. It was a great scam if they get away with it. I'll post what happens after legal completes the review in about 1-2 weeks.

Who was it financed through?  Was it the bank or the dealer?

 

I've heard that many of the "buy here, pay here" used car lots business models rely upon aggressive repo'ing of vehicles.  They charge inflated prices on cars, with big downpayments and high interest loans.  People essentially only pay interest on an indefinite rent-to-own schedule, then eventually give up because impossible terms, only to have the car immediately repo'd and re-sold to someone else.  They also install kill switches, which render the cars inoperable if a payment is missed, as well as GPS tracking to find them.

 

Even the shadiest "normal" dealer is going to finance through a bank, so they're done with the transaction as soon as the loan goes through.
