Hello and thank you for the response.. I have gone to carma,. They only offered me $10,200 for it. I have not listed it on craigslist yet because I don't have the difference saved up. I've never filed for bankrupcy before, have definitely considered it.. Right now all of my scores (and wifes) scores are in the low 500's due to several late payments on our mortgage and cars.. Recently had the mortgage remodified so good news is it is now current. I do have a repo that is about 3 years old now. the car I'm talking about was once leased (big mistake in the long run) we fell behind and the car was taken, we were able to scrape the money up to get the car back.. I'm just wondering would they sue me right away for balance or be willing to work out payment plan.. I was told by Cap 1 that every case varies. I was also told by them there would be no interest on the balance as long as I agree to work with them.. but I'm just not sure if they will want the balance in 30 days or be willing to allow me to make payments..

Sorry to hear about your troubles, I’ve been there- after my divorce my home went into foreclosure and my ex stopped making payments on the truck we’d financed that he got in the divorce. It was a train wreck of a situation so I can completely sympathize with where you are.
Congrats on the home loan mod- it was a lifesaver for me and my situation.
Reading through the comments it looks like you’re already in repo territory, they picked up our truck right at the 120 day mark.
Given your situation, not that would I ever advise a allowing a repo after what it did to my credit. You’re so upside down and already behind that refi likely isn’t an option and selling it will still leave you with a deficit. It may be in your best interest if you’re caught between being able to afford your home or your auto loan, sometimes you just have to pick and you’ve gotta have a roof over your head.
I’m almost 5 years post repo and foreclosure proceedings and up until last week, I drove a cash car that suited our family well enough and got us where we needed to go reliably while I worked on fixing my train wreck credit.
As far as our repo- we paid around $21k for that vehicle, owned it for 3 years and the balance owed at time of repo was $16k, including fees. We lucked out and it auctioned for $12k so I was hit with the deficit balance of $4k. At that time, WFDS was willing to work with me and settle but I had just had a baby and had barely scraped by to save my home so it wasn’t an option and now they aren’t willing to accept payment and have changed it to a charge off sometime in the last couple of years.
I’m willing to bet that once your car is taken and auctioned that CapOne may be willing to settle with you and if I were you I would heavily consider that so you don’t have them reporting every single month that you fail to pay the deficit balance so you can be on your way to repairing your credit sooner than later.

Thank you for your response.. Yes, i am definitley leaning towards turning the car in. The only thing that is holding me back, my wifes car will be paid for in about 9 months.. which will give us some wiggle room.. but it's going to be a struggle holding on for that time period because we have other bills as well.. and being so upside down it seem pointless to continue to pay. Once again, thank you for your response! it's greatly appreciated.

Just out of curiosity, did they want the lump sum after the repo, or were they willing to accept payments each month?

I was dealing with Wells Fargo Dealer Services, but within 2 months of picking up the truck and auctioning it (it was auctioned within 7 days off repo according to the paperwork) they offered a lump sum that I think was around $2.5-$3k or monthly installments. If I had it to do over again, I would’ve scrambled for the funds and taken the lump sum offer.

dont fall for anything cap1 tells you. You have DEFAULTED, yes a payment arrangement is possible.

If you do get $10,200, how much of a loan balance remains. (irrespective of late/no pay for last 3 months).

 

I would hire a  NACA lawyer if cap1 sues and cap1 is known to go to courts more often than other companies.

Do you even know when exactly was the very last payment you made to capital one on this car? Make note of that date and month.

Have to be accepting of the fact that a derogatory will stay on your record for 7 and half years from your last payment date. can you actually live with it. Remember, cap1 is not govt and cannot seize any of your assets via wage garnishments or the likes. It has to go thru courts and an order issued before wage garnishment happenzzz.

 

I m not a lawyer but i have survived two derogatory worth $100k+ living for 7+ years without paying a dime to creditors. Unless you are ready willing and able to survive the derogatory your best bet would indeed be Bankruptcy.

i'd suggest dont let your wife's car go? do everything to payoff wife's car?

Even a 30 day late on wife's car will not look good for future. it will haunt you for very long.

 

do not shy away from applying for Loans everywhere you can to make payments on your wife's car. even if it means taking money out of credit cards with high interest or car title loan and making payments.

 

I have taken car title loans very often & knowing you will be paying $75-$100 in interest only is much better than taking even a 30 day late on credit report.

Definitley.. my wifes car is not the issue.. it is mine.. we have made sure to keep up with payments being as though its almost paid for.. a little over $3k to go.. My car still has a balance of over 19K two years later.. the original loan amount was almost $21K.. terrible..

I still owe 19k on the loan, we have been making payments every month. but being as though it's behind so much, each payment is keepling the car from being reposessed.
