Chapter 13 Dismissed. Credit Reporting Questions.

Hello,

Filed Ch13 10/10. Dismissed (not discharged) 8/12. Had a car loan that was included in the BK and was PIF 9/28/12. They are reporting to the CB's that I have been 180 days past due since 10/10. Is this legit? It was included until 8/12 then PIF 9/12. It just does not seem they can go back and date the loan like that.

Please advise. Thanks!

Well your BK was dismissed not discharged so the creditors that haven't been paid can come after you for what you owe as you did not get your debts forgiven. So yes the reporting is accurate, unfortunately.

It's unfortunate that you didn't finish the plan and get your debts discharged. The Chapter 13 will be on your credit report until 2020 instead of 2017 and there is a potential for collections and judgements from those creditors until you reach SOL.
