FINALLY REMOVED!!

OMG over 6 years after my BK I FINALLY (probably because it's about to fall off anyway but I needed this win, I have been fighting it until I was blue and past blue in the face!)

I had student loans that were reporting on the "Negative" side of my credit report as included in my bk.

1. Student Loans can NOT ever be included in bk

2. I was not delinquent nor did I ever become delinquent... in fact even though you "can" stop paying without penalty while in BK if you wish, I continued to pay the entire time

I finally said to EX, who the heck is verifying this and looking at this... what part of can't include in BK doesn't anyone understand and I have sent you my BK papers so if you don't actually handle this correctly I'm sending a different kind of dispute next time and it will be to your company! (guess it got reviewed this time Smiley Tongue)

tiny victory for the small person today against the big huge corporation!

Re: FINALLY REMOVED!!

So, all three of the CBs are showing my student loans as IIB?  Do I need to dispute AGAIN?

I was told once way back when it first happened that it was standard procedure for student loans and I said that is frankly not fair because in my case that left me 2 negative accounts rather they were included or delinquent at all... in a computer system it always showed 2 negative accounts...

so once I was no longer in the bk I then felt it was no longer okay for it to be "procedure" since now I was out and the loans went back to a different lender and I was paying but I still showed these 2 negative accounts... fast forward I have disputed probably 6 times or more and just now got them off... so i dunno in the end... like i said now im not that far from them falling off but I am telling myself I still accomplished something great! im not sure at this point they really effected my score even, but still in all reports that show past negatives, they were 2 so i guess in some way they effected something!!

Re: FINALLY REMOVED!!

Well then, I think I know what I am about to do.

Anything in particular with your wording that you used to get them to finally listen?

I told the guy I wanted to dispute and he said it looks like you have and was verified... I said I know... "Who is verifying because we all know student loans CAN NOT be included in bk and I believe I have but will provide AGAIN if needed my BK DISCHARGE with NO student loans listed"

Re: FINALLY REMOVED!!

As an FYI - an FCRA attorney (NOT a credit repair agency) would have done this for you for free (usually very quickly) and gotten you $1000 cash bonus per tradeline for your pocket.  FCRA violations get your attorneys fees paid for you, which is why it's free.

Regardless... its TOTALLY AWESOME that you had the strength to see this through!  Great job Creditaddict!

RedSox7 - might be worth it to give one (in your home town) a call.

I am not an attorney and none of what I write should be construed as legal advice. For legal advice please consult an attorney.

Starting Score: ~470 preBK(8/2010)
Current Scores as of Late January 2016 All 700+. Last CR pull from a lender(housing) was mid-score 749.
Goal Score: 700+ - reached.

well if an attorney would have breathed near me I would have loved to let them handle it but back when I was in my BK I learned I was better doing things myself because my attorney's office knew less about it then I did and alost sent off very incorrect things to the trustee before.
