Forgotten Collection

Hey all! Wanted to see if this has happened to anyone and how you handled it. I will reach out to my lawyer as well but like to hear personal experiences. My credit was a mess. Medical bills are so confusing and the way they split them up between departments is rediculous. So there is one I didnt realize was out there and wasnt included in my bankruptcy that I recieved this week. What can be done here if anything? I am wondering if I could reply with my filing and hope they remove it? The deby was before I filed, by years. I was discharged a week ago. Thanks so much!

Welcome to the forums @newstart2022 

You answered your own question in a way. People forget at times. If you were a no assest case. Most courts would view your error as a "no harm, no foul" situation and discharge the debt. Because the unlisted creditor wouldn't have received anything even if you had remembered to list the debt. Let your lawyer know though.

 

On the other hand your lawyer pulls your reports and should have seen it also. Least mine did.

The same exact thing happened to me. i called my lawyer and was advised to send a letter to the collection agency trying to collect the medical bill including the date of my bankruptcy discharge and all the info such as numbers etc. i havent heard from the collection agency since, over 2 years.

Hey guys,

 

I think I just had this happen to me too unfortunately!  I just got my Chapter 7 discharge last week and am trying to do a deep scrub of everything to make sure reporting is updated and whatnot.  I think I just realized I completely forgot to list a small creditor in my Chapter 7 filing entirely, although there is nothing showing up (as of now at least) on my credit reports, and there never has been for this debt, so that's most likely why I forgot as I had tons of other accounts I was trying to keep up with when filing.  Are you guys saying this is the same situation you faced?  Like you didn't even formally include it in your BK filing, got your discharge, and then found out about it after the fact?  Then your counsel advised to send said creditor a letter detailing you had just filed for Chapter 7 and had been discharged, including the discharge documentation in your letter, and that creditor is still legally required to abide by terms of the Chapter 7 and clear the associated debt entirely?  Or am I misunderstanding?  Would definitely be helpful to know, and would save me the trouble of having to go back to my counsel and explain the situation (and only further prove I am indeed an idiot lol).

As mentioned. Send them a copy of your filing and DC. That should end it. It happens. If not. Then contacy your lawyer. Good Luck!
